financial hardship response

My husband and I are in the middle of reclaiming our bank charges from hsbc, we asked them to consider us as we are suffering financial hardship as my husband is unemployed at the moment. Today we had a call from them saying they are not willing to pay untill the court hearing, but will pay us £500 then another £500 in three months if we are still in f.hardship. I have never heard of this so not sure what it means. Do you know how I should deal with this reply???? It is no where near the amount we are reclaiming.
