Should I twist or stick?

To cut the long story short I have been offered £1600`ish on hardship grounds. My charges actually total £2400`ish.
So my options as I see them are
1/Take the money (My overdraft is £1800 and they have already written to me to say my account has been passed over to collections)
2/ Write to them saying I want the lot or were off to court for the day.
3/ Ask them to consider £2250 as a trade off.
4/ Ring the A team. BA always wins.
How can I find out (before deciding)that If I go to court that my case will not be stayed. If I threaten to go there I need to know that it will get there if need be.
Any advice please?

Your court case will be stayed regardless. BA is getting on a bit so A Team is out.
The bank won't care if you threaten them.
If you are in financial hardship then accept the money are argue on the grounds of priority debt arrears(rent/mortgage, utilities, council tax).0 -
Their offer is on a goodwill basis, which means they will still be liable to pay the balance at the conclusion of the OFT test case..
If the offer doesn't cover priority debts owing such as:
Utility arrears such as gas/electricity threat of being cut off
Mortgage arrears
Council Tax arrears
Threat of repossession
you could try ringing and negociate a higher offer0 -

Could you please just help me with two more things.
I understand the bank has 40 days to send me a list of all charges. I want to check that my sums are correct and thought it would be a good idea to request them (to prepare myself for the remainder of my claim). My first claimable charge is in Sept 2001 and my last one is in December 2008. I believe my total claim as mentioned to be around £2,500 but a section of the letter offering the goodwill payment is suggesting they are making a payment "equivalent to these charges"
1/ I assume I will be able to claim all of these charges (Sept 01 - Dec 08)
2/ Can I request a record of charges for all of this period and should I do this now or wait until the cash is in the bank?

Worth checking for July 2001 onwards

I can't see a reason why you shouldn't ask for a complete set so that you can double check their figures
