Can I get 3x deposit back from landlord??

Hi everyone. I fairly recently (4th April...) moved out of my previous rented house into a new one having been there for four and a half years. As my landlord held the deposit, the letting agent has told me that it is down to me to get my deposit back from him (rent always paid on time and agent agreed perfectly fair wear and tear), but despite numerous attempts to contact him by phone and one long email, I've heard nothing back from him.

I knew nothing about the 3x's deposit for not protecting it until reading a thread today, and as I never received anything in writing at the time the new legislation came in, I assume he didn't protect it. Does this mean that rather than keep chasing him for the initial amount, I can threaten him with legal action to get the three times amount instead? Any info greatly appreciated... Thanks.

    when did you sign your last tenancy agreement ?
  • It was at the start of the tennancy, so around October 2004. It was for six months and then rolled over every month.

    Then no, you are not able to claim.

    Only tenancies granted or renewed after April 2007 require the scheme to be used.

    As your original and only tenancy started before this the LL was not obliged to register your deposit.

  • Sorry to hijack this post but is it true you can claim 3x the deposit back if they havent protected it? is there a link with more info on this please?

    Aslo is there anyway to check that the deposit has been protected. We did not have any info about it at the start of the tennancy in our old place unlike the new one we have just moved to.

    if the tenancy changed / moved letting agents after the 2007 cut off does this count?

    there has been no test cases as to whether a change in tenancy conditions, or a written renewal to the same tenant means that a deposit should be protected

    i protected all mine on renewal just to be on the safe side
