Nike Trainers Incorrect Size

I purchased a pair of Ladies Nike Shox Trainers size 5 from Ebay. £35 plus £5 p&p. I wear these trainers for gym all the time & they are comfortable. When they arrived they are obviously not a size 5. I would say they are about a size 3, can't even attempt to get my feet in them. They were unboxed but have a label in saying size 5. I contacted seller explaining situation but he didnt offer to replace or refund them. He just sent an abrupt email. I then left negative feedback explaining what had happened, he has just added a message to it saying that correct size was sent.
However, the next few people to buy from him have given positive feedback even though he sent the wrong size because he has refunded or replaced their goods.
Is there any action I can take or do I just put it down to experience?

Assuming you paid by paypal start a chargeback for item not as described.
However, you were a little hasty in leaving negative feedback so quickly as it will mean the seller will be less than helpful now.

Have you checked the label just inside the tongue of the trainers, its usually in there the size. Then if it is def not a 5, then the seller has sold you the wrong item0

Sounds like it might be a US 5 which is about a UK 3

There is no label on tongue of shoe, just on on the inside, which says UK 5, US 6.5, I don't know whether they are genuine or fake, they were unboxed but I knew they would be when I bought them. I only gave negative feedback after several emails, I only had two replies and neither were helpful, in fact they were just plain rude. He still sells trainers so you would have thought he would have at least offered to exchange them.
He charged £5 pp but they were in just a flimsy brown envelope, also he had no address marked where they had been sent from which I thought was strange. He has had negative feedback in the past with similar story.
I didnt know I could claim anything back under Paypal. I did pay for them this way.Be ALERT - The world needs more LERTS0 -
I have a pair of Authentic Nike shox bought brom Redoute and the label is on the side also, not on the tongue.
It's possible they are factory rejects due to incorrect size.0 -
I will just have to put it down to experience. A bit disappointed as I am doing Moonwalk in May (26 miles at midnight for Breastcancer) & I wanted to get started training in them so that they would be comfortable on the night. I wore Nike Shox last year and they were comfortable.
I will now have to buy another pair which has delayed being able to break them in.Be ALERT - The world needs more LERTS0
