    Hi Rob,
    Ok the way I see it which might not be the correct one :rotfl:
    You paid a deposit in good faith but found out further details after the deposit which alarmed you.
    You asked for your deposit back to which he agreed with the proviso of him selling the car first and you paying for an advert to be deducted from the deposit.
    He has now sold the car and is trying to avoid paying the residue.
    You are left with out the deposit and the car is no longer available to you.

    I think in those circumstances I would write to him recorded del. and state that you require the return of your agreed deposit within 7 days or you will be applying through the court.
    Attach a photo copy of the paper he signed so he knows that it reminds him it exists.
    I take it there are no conditions on the deposit slip such as a time limit or being non refundable etc
    It's not just about the money
