Abbey, hardship offer.

Hi folks,
The Abbey have accepted that I am indeed in financial difficulties.
I claimed for £2100 and they have made a good will gesture of £299 to pay off a few debts.
I really want to knock this back and ask them for the full amount. Do I have to ask them to look at my case again, now they accept that I am in financial hardship? Or do I knock it back wait for next offer, final offer and if still not happy take it to the Financial Ombudsman; and ask him to ask Abbey why they are not paying me back the full amount.

You need to accept and negotiate a higher amount based on your priority debts arrears. For example, if your priority debt arrears(mortgage/rent, council tax, utilities) are higher than £299 then negotiate on that basis. Remember, the whole of your remaining outstanding charges are still valid once the OFT test case is completed. This is by no means an end to the claim since the bank cannot offer a full and final settlement of the claim.0 -

I was under the impression that since they now see me as hardship, I have my foot in the door I.e I have passed the point of getting my complaint stayed, not looked at till after high court case etc
Does this not now mean that they have to investigate it, give me their final decision... make me an offer, perhaps, and then if I am not happy take it to the FOS.
Your help is sooooo helpful.

Owen, have they given you an offer ie £299 or did I misread that bit? They don't have to refund even 1p under financial hardship but they can make a payout to ease your financial hardship, and they have been reminded of their obligations by the FSA as recently as March, this year. I think you need to see if they will up the amount based upon your financial hardship today.0 -
