Ammending a Building Control Completion Certficate

Hi,

When we bought our house it had a few extensions, all ok and above board.

But on one of the drawings for one of the small downstairs extensions was plans for a loft conversion. These were all passed etc..

On completion of the downstairs extension, the council signed off both extensions, loft(which hadn't been started) and the downstairs one. And issued a completion certficate saying loft extension and ground floor extension complete..

Now, the problem, when we bought the house we didn't notice the loft extension on this completion certificate, but now it has come to light and we need to get it ammended.

How easy is this sort of thing to get changed, bearing in mind we are removing an item, not adding an unapproved one.

I have tried ringing the council and solicitor for advice but neither of them are available until tomorrow and its panicing us.

    I was just about to add to my post, I knew i had forgot the important bit..,,

    The stupid thing is that anyone who buys your house has carte blanche to do a loft conversion and not adhere to building regs as they've already been signed off.

    Although there is the above "moral" consideration, I see little point in trying to rectify something that a previous owner should have done, it certainly didn't affect/influence your purchase and shouldn't your solicitor have noticed this when you purchased?
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    I suggested that the buyer could do as you said, but he would like it ammended..

    Looking back through paperwork, our solicitor had pointed it out but probably due to the wanting to huryy up and buy this place we didn't see it at the time or more truthfully most probably ignored it... Because of the number of extensions, we just went with the flow and signed away. etc..

    I can't think that it would be that much of a deal to ammend as we are reducing what was on there, not asking them to add anything.. Its more of the time fram i am worried about.

    Ask your solicitor to speak sensibly to your buyer's solicitor.

    It does not affect the sale and therefore if he wants it removed, he can do it at his own convenience once he's moved in. Frankly, he's being ridiculous and if your solicitor has any gall, they will point that out in certain terms for you.

    If you speak directly to building control they can move things pretty quickly but I doubt there's any procedure for it.

    After he's bought house, buyer can get paperwork amended if he's that perturbed by it. I can well understand conversion not having bldg regs being a problem, but can't see the problem of bldg regs not having conversion!

    I agree with both posts - I can't see what the problem is - just a a legal curiosity - what possible detriment is the seller saying he might encounter?

    There are enough problems in house buying/selling, without creating non existent ones. Sandra you have my sympathy, hope buyer doesn't turn into a nightmare.

    Many thanks for all your replies..

    Glad to hear you think along the same lines as me,, that it isn't that much of a problem, or at least hope not..!

    The buyer wants it ammended before exchange so that's up to me then i guess. Hopefully it will be a call to the council and then maybe a visit then new certificate issued..Will speak to the solicitor in the morning and say my bit....
