Another car deposit quiery!!!

Hello People, how do's?

Just want your opinion really to see regarding something that happened to me a few weeks back.

I am a driving instructor and I went to look at buying a new car from a respectable dealer recently. After looking at the various models and variants I decided on a car I was interested in and the saleslady had a look to see if there was anything to match my specifications, there wasn't. I was offered a suitable alternative and decided to go and think about it.

When I got home I thought I'd try a different dealer (same manufacturer though!) to see if they could get the spec I wanted. They said I was in luck and gave me a price. I thought that was fantastic but felt guilty about changing dealers. So the following day I called the first dealer and said I'd found the car I wanted and asked if they could get it for me. They said yeah no problem so I gave them a £200 deposit.

Trouble started here as the first dealer didn't give me a price before, during or for 24 hours after I paid the deposit!!

I went in the following day to finalise some of the finance package with an accurate figure in mind, based on the interest rate and apparent cost of the car, and the figure they ave me was £40 per month more over 2 years. I questioned this and they broke down the figures they had. They said the price of the car was about £500 more than the original figure I was told.

I've since told them I don't want the car due to the change in price and they asked for it in writing. I have handed in a letter and just wanted to know from you all what my chances are of getting my deposit back?

Now I know this mail is long (for which I apologise) and it's only £200 (I'm quite stubborn!) but I just want a bit of advice so I know where I stand.

  • So to clarify

    1) You went to dealer 1 who didnt have spec you wanted
    2) Contacted dealer 2 who gave a price for spec you wanted. you didnt order
    3) You contacted dealer 1 who said they could get car and you left a deposit for this. No price mentioned

    4) You think you shouldnt lose your deposit because Dealer 2 who didnt quote a price are dearer than dealer 1.

    If I am reading you correctly get on your bike.

    To be honest it sounds like you made a schoolboy error, I'm not a legal expert but I very much doubt you'll see your £200 again.

    Why did you put down a deposit when you didn't know how much the car was going to be?

    Result People!!!!

    I recieved a cheque today from the Car Manufacturer for the whle £200!!

    This was after a letter I sent explaining what happened. It did take them a few weeks to reply but I have my money.
