Giving up a Private Let

Hi

My sister has a 6 month lease on a private let and I think she is now in Month 2, she would like to give up this as she isnt getting on with the landlord.

To give you a brief idea of what has been going on - When she viewed the property she was advised the items from the previous tenants like buggys, kids toys, plates, cups etc would all be cleaned out from cupboards and drawers and the over flowing contaminated bins would be emptied and cleaned and that the landlord would make an appontment within 2 weeks to check everything was ok. 2 months later and the items are still there (all packed and put in a cupboard by my sister), bins are still over flowing and contaminated and the landlord hasnt replied to e-mails, calls or calls to the letting agency to contact her about repairs that need done, like a hole in the bedroom wall she didnt see as it was behind a door and the bath tap doesnt work and kitchen unit is loose and looks like it will fall off, she isnt able to completely move in as she isnt able to shower because of the tap not working and also sometime the toilet doesnt flush.

She has contacted the letting agency with these concerns and they have tried to contact the landlord but cant and say there is nothing they can do since they only had to let the property.

She called them again on friday stating that she is going to give up the tenancy as there is no point paying for it if she isnt able to completely move in and they tried to talk her out of it and said they would try again and contact the landlord. 10 mins later the landlord called and asked what her problem was, after explaining repairs that need done and still items in property from previous tenant she turned around and said "so what do you want me to do about it!"

Is there some kind of procedure she needs to go through to give up this tenancy and get her deposit back.

    I think the replies you will get will be along the lines of "She signed for 6 months so shes tied in for 6 months".
    Does she have an address for the Landlord?
    It is best in these situations to have a paper trail so have her send a letter by recorded delivery to the landlord with a list of repairs that need doing.

    Thats what I thought, she is going to write a letter and hand it into the letting agency and see what they say, I checked the tenancy agreement and it says in it that they need to be contacted about any repairs and they will be fixed in a reasonable amount of time, she contacted the letting agency and e-mailed the landlord about things that need done as that was 7 weeks ago and she only got contacted by her a few days ago to see what she was moaning about.

    She spoke to the neighbour who said that there is a high turnover of tenants thats been in this property as the lamdlord doesnt seem to care or get anything fixed.

    anyone else know how she can get out of this tenancy?

    Write a letter, send it recorded delivery. Phone calls and e-mails are not formal communication.

    *All* repairs issues should always be reported in writing, with a copy kept by the T. If a Ll does not get repairs done within a "reasonable" time then the T can uses a very specific method to get the repairs done and reclaim the amount from rent monies that become due. See here.


    The only way that your sister can leave this property is by the LL *agreeing* to her leaving and she'd be expected to pay advertising costs etc and pay the rent up until a new T moving in.

    There is a private sector rentals officer at the local council who can help with issues like this.
