Bullying at work and sick pay help

Options
Hi
I have had a issue with a fellow employee at my pl,ace of work in which he continually harassed and bulled me over a period of time. The bully was given a final warning but continued to due things after this. I have been off sick for 16 weeks now and come to the end of my sick pay entitlement. I have a grievance meeting with the company in afew weeks time to discuss my return to work but they have canceled and rescheduled it to a later date. The bully is still there and i am afraid to go back to work whilst he is on the premises. The company seem reluntant to sack him or do anything that will make it a safe place for me to work. Has anybody got any tips into what to do because I feel why should i be docked pay beause of fallings of the company.
Thankyou

Been in similar situation tho in my case bully was let off as had been there longer than me and was my word against theirs. My manager actually told me to try harder, i did but you cant have a one sided conversation can you? Anyway, have you got documentation relating to bullying ie dates times etc. are you in a union?
how long have you worked there? You could seek advice from CAB as well but I ended up leaving the company to get some peace and am now redundant so looking back was not really a good move or maybe im just unlucky.
I 'd try to ride it out as jobs are hard to come by. If you havenet got a diary, keep one now and record everything, try to get witnesses who may back you up.
Hope it works out for you, let me know how you get on.

I feel for you I've been through pretty much the same thing. Do you all work in one office in the building or several? Do you have any other buildings where your employer operates from?
I went into my meeting with my OH with some suggestions for them as to how they make it right. Ask instead to work from another location. I am now, same building, different office and team mates. Person still works there and does/says stuff when they see me but that is not much now. Could you do the same? They can not just sack someone for you unless it is all legal and in line with company policy. Pay/sick pay would fall into whatever their policy was and thats what they have to follow for everyone and it may mean going on to SSP or applying for state benefits if it's company policy to only pay or pay SSP for a set time.

ACAS should be able to help. rearrange a new appointment. Keep a record of the bullying and yes, trade union will help. If you are scared to go back to work, what form did this bullying take?

Is going back and then if you are not coping, making another complaint and going off sick again an option?

Sorry if the quote are funny i'm no good with this sort of thing
What is the exact grievance with the company?

The bully attacked my from behind he was given a final written warning and then continued to harass me afterward. The comapny said anything he does he will go but they have failed to do that.
how long have you worked there?
    About 10 years.
    are you in a union?
Yes, they are helping me fight it, however they want witnesses which i have got but the company have faled to ask them even though i've told them who they are and what events they witnessed.

I have suggested we work in another unit as there is two, but the company state it would not be viable. I have suggested various things to allow me to return to work but the company haven't replied.

    Thanks once again

He attacked you - do you mean he physically assaulted you? That should have meant dismissal as gross misconduct, not just a verbal or written warning.

This sounds like a good chance to bring a charge of constructive dismissal against them. The firm have obviously decided which "horse" they are going to back, and that means that life for you will be pretty unbearable, because they will let the bully get away with anything, whilst turning a blind eye.
About ten years ago, a boss had a go at me in front of the whole office - shouting and swearing, and then ordered me into his office. I refused to go, saying that he was not in a fit state to talk to anyone on a one to one basis. He went to HR and called a disciplinary meeting, where I was completely cleared. The problem was, that the boss stayed, and I was bullied continually, until I left three years Later. I went straight to an employment lawyer, and he brought a case of constructive dismissal against the firm. We won, and I was able to leave the firm with enough money to help give me time to find another job, and move on.
    Good luck,
    Andy.

He hit you? How long ago? No chance you can call the police? This def should have been immediate dismissal. Have you also laid a grievance about your employers behaviour, not just this bully, and their not following company policy / supporting you?

Thanks for your support everyone, it's been a hard time for the entire family.
He hit you? How long ago?
The first event came out of the blue when he throw a large object at my legs and then suddenly came for me. This was October last year. I think he was sent home on full pay whilst they decided. He was given a final written warning and I was told by my manger that anything he did after this event would lead to his dismissal. After this warning he continued to harassment and there been a few shoulder barges. The company haven't yet done anything about this.
No chance you can call the police?
The police have been contacted and they said it was a company matter and they should sort it out.
He attacked you - do you mean he physically assaulted you? That should have meant dismissal as gross misconduct, not just a verbal or written warning.

Yes, it says in the company handbook that it would be dismissal after an assault. I have continually outlined the section in the work handbook to them but they always have accuses.
I have tried to be reasonable with the company by asking them if i could work at separate units as this is possible where I work. We have two units of which i could work at the one and him at the other. They don't want to know.

    Thanks for your support everyone.

    Hi Jack

Can I start by saying that I am utterly appauled by this person's behaviour, but hopefully the good people here can support you through this very difficult time.
Although I have nothing constructive to say to you, I am going through something similar myself, and I can sympathise with you no end.
What start's out as general nit-picking, soon becomes downright bullying and harassment and it's hard to grasp sometimes that adults can treat someone so disgracefully.

    Chin up, thinking of you.
