Credit Card Reclaiming - Help on next steps....!

I have searched the boards but have a couple of quick questions I hope someone can answer. I am trying to reclaim from both Nationwide and Capital One.

Nationwide - received their small offer of £38 (claiming for £284.00) and wrote to them saying I will turn it down. They then sent one back saying tough and they won't do anything else. Please advise, is the next step the FOS or the court?

Capital One - sent letter asking for charges back and wanted a response in 14 days. This time has passed (easily) and they haven't responded. Shall I proceed to the second letter or try the first again as they may not have got it? (or that's what they will say!)

Thanks for any advice.

    Ok, If you fancy an interesting read then OFT 842 is ideal because in point 1.14 it tells you what to do and even gives you the case law. It also states that only a court can decide the claim.
    I would write to Nationwide on the lines of "thank for your letter of xx amount", then tell them that the OFT clearly have said in their report that only a court can decide a fair fee. Explain that you are trying to save them the additional costs of court and that you want the full amount or you will take the claim to court and make the judge aware that they were given a chance to settle before taking out a claim against them.
    With MBNA, I think Oscar52 can give you some advice on that
