Help needed getting a refund

On May 8th I ordered a watch online and was told delivery would "usually be within two weeks". Two weeks came and went, and no watch. I wasn't to worried though and sent the company an email asking if there had been a problem with despatch. Seven minutes later, I had a reply asking for my order number and/or my address. Things appeared to be moving quickly and I was reassured. I replied later that evening (I went out after my first email & didn't get the reply until later), and got an email back on the morning of Monday 26th May stating:

"We are currently awaiting stock on this item, this should be due to arrive into stock with us within the next week and will then be dispatched."

I replied to this email stating that was unsatisfactory, as I had had no confirmation email of my order and not even a courtesy email letting me know that the item was out of stock. I asked for my order to be cancelled, and a full refund issued. I got no response. Four days later on May 30th, I sent another email requesting confirmation that my order had been cancelled & that a full refund would be issued. Again, no response. Then Friday June 5th, four weeks after I'd originally placed my order, I received the following email:

"Unfortunately it seems this item may be out of stock with our manufacturers. Your order has now been cancelled."

I am STILL waiting for my refund and have had no reply to my emails. This morning I have sent another email threatening to take the matter further if I do not receive a full refund. £61.80 may not seem like much money to the company in question, but it's a lot to me! Especially when I have paid it for something I haven't received.

If anyone could offer any advice on the best way for me to get my money back, I'd be extremely grateful. I know that if I went through my solicitors with their debt collection services, they would charge me around about £50. I also considered small claims court, but wouldn't have a clue how to go about it.

    If you paid with a credit card you should be able to get a chargeback from the credit card company. Phone them, explain the situation and ask them what the procedure is.

    Possibly if it was a Visa card they have a rule known as Visa Debit Chargeback.

    If it was a Visa card get in touch with your bank who should put the transaction in dispute

    Other credit cards do not have this rule

    I have just spoken to my bank and they've said they can claim the money back for me using this method! :-) It may take a few weeks, but they're now onto it. Thank you! :-)
