Won auction, seller rufusing to complete

Obviously it didn't make the price they hoped for, and have said (falsely) that item was sold privately.

The seller lives locally to me, although I do not know them, they are advertising this item at a much higher price in local shop windows and I am sure thats why they have decided not to conclude the Ebay transaction.

I have never experienced this before and do not know how to

a: Report them as a non performing seller
b: How to remove this from my "won items section" of my ebay
c: Take any other appropriate action.

I know nobody can force someone to sell and although they have entered a contract the only way to enforce is via small claims court (probably not worth while although VERY tempting)

Any advice comments welcome.

PS. I was talking to them via email only an hour before the end of the auction and to be honest the seller did seem like a young(ish) person so whilst I would not like to "punish them severely" I would like to show them such behaviour is not acceptable.

Personally I would do a non performing sller complaint and then maybe consider a neg in a week or so when you've had a chance to think on it.

    a. Seller Non-Performance Policy click on Additinal Information to expand and see applicable link.

    b. click on 'won items', check the box next to the applicable item and then click delete

    c. Other than negging the ebayer, I wouldn't bother. If the person is under 18, claiming for compensation through a small claims court would fail anyway Under 18's cannot form legally binding contracts, and shouldn't be on ebay anyway. You can report underage users here:
    http://pages.ebay.co.uk/help/policies/identity-underage-users.html
but ebay never act on this in my experince, no matter what evidence you provide them with.

First of all sorry for the typo in the thread title:o

    @ Soolin and Premier.
Thanks for the info, it seems I may even have been lucky on this occasion.

The item I bought was an eletrically assisted bike (looks like a motor scooter) and when I phoned the local dealers they knew the bike and told me it was 3rd hand and had been involved in a major accident:mad::mad::mad:

Their opinion was I should avoid at all costs (They had it in their workshops at one point) and have spent the past 3 months supplying parts for the owner to put it back on the road.

As the owners/sellers wouldn't pay for it to be professionally repaired nobody could be sure what condition the bike was currently in!!! So who knows what I would have ended up with. Also the information the seller gave me in ask seller a question was completely wrong so had the sale gone through I would probably have had major problems with it.

(I still want these people banned from ebay though, they lied and cheated and were prepared to sell a badly accident damaged vehicle without warning the buyers in any way:mad:).

What sort of feedback do they currently have? If it is a low turnover account then a non performing seller complaint and a neg may get them suspended temporarily anyway.

would you believe they have a zero feedback? The only reason I bought was because it was a collection only purchase.
