defective watch.............?

I bought my wife a watch for Christmas - quite a reasonable one, cost about £80. After about 4 weeks she noticed the glass had cracked. She had not been aware of banging it or anything. Took it back to the shop, they said, sorry, the guarantee doesn't cover the glass and it has to go back to the manufacturers to be fitted. Fair enough, I said. Got it back after a few days, they didn't charge me for it. 3 weeks went by, and, lo and behold, the glass is cracked again. No idea how it happened. Took it back, they clearly didn't believe it hadn't been dropped or anything, this time they charged me £15. Guess what? A month later and the glass is cracked again. My wife was in her office working at her computer at the time. I reckon there's something wrong with the watch, out of shape or something, but the shop still don't believe it's not being misused or abused. It's gone back to the factory again and the shop say they will only replace it if the factory say it's faulty. Thing is, my wife's lost confidence in it, daren't wear it anymore. Are we entitled to a replacement, or better still, a refund?

If the factory say it's faulty then you are entitled to a refund. You've had it some time, so the trader may argue for a partial refund taking into account the usage you have had from the product. However I would argue because you have already paid £15 for a repair that damages of £80 would be appropriate. If the factory can't find anything wrong with it see if you can find a real watchmaker to take a look and provide proof of a manufacturing defect.
