redundancy and length of service

hi
i wonder if anyone can clarify this
ive just been made redundant
i have worked for the company for 4 years and 2 months
but they are only paying me for 3 years redundancy and 3 weeks notice period
they say that the 1st 3 months was on agency so i dont qualify for 4 years only 3
i have a letter from the company dated april 05 that says they would like me to start asap on a temp to perm. basis and for the 1st 13 weeks i will be paid thru the agency. i started on the 2nd may.i have no other letter saying anything else and no contract only an induction form signed and dated may 05.
the question is are they correct or have they got it wrong and is there anything i can do
please help

    If you were paid by the agency for those first 3 months on their PAYE system, then your employer does appear to be correct as you were not directly employed until the fourth month.

    Hi Ricky,
    Are you on weekly pay or monthly
    Does your contract say 1 weeks notice or 1 month
    If one week they are paying you correctly.
    If 1 month then they should be paying you one months notice,
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    With a letter that says you are to work for the company even through an agency I would look at a claim anyway.

    It is a simple one for mediation to rule on.
