A refund amount DEBITED from my account!

Hi all,

About a month ago, I had to return some concert tickets as the act cancelled and everyone was entitled to full refunds on the tickets. The cost of the tickets amounted to £105 and I requested the amount be paid back onto my debit card instead of in cash. However, when I checked my bacnk account two days later, the amount had been DEBITED not CREDITED to my account, taking me overdrawn (unauthorised). The ticket store didn't believe me when I called them, and I had to go down there in person with a printed bank statement to show them their mistake. They eventually gave me the original refund and the mistaken debit amount back (£210) in cash this time whic I paid into my bank account. However, I have since been told by the bank I will be charged £13 for use of an 'unauthorised overdraft' because of this error which it only seems reasonable the ticket shop should pay??!!

How should I approach this issue?? I have only received the charge notice today and am drafting a formal letter to the ticket shop but not sure if there is any legislation etc. I can cite?

Any ideas/advice/hints/tips???

    Technically, they have applied an unauthorised debit on your account - mistakes happen but it is theirs, not yours so it is not up to you to incur costs. I'd send them the letter, with proof of the charge that is being levied by your bank and ask them to refund you the amount as it has arisen entirely due to their error.

    Speak to consumerdirect, I'd expect this is not a unique complaint and they probably have a standard letter that you could use.

    I'd also phone my bank and explain the problem as you wouldn't want this to adversely affect their opinion of you.

    In general if they have been negligent they are liable for any direct consequential losses arising from their negligence. That should be all you need...

    Hold out for ALL of your costs on this one and if necessary take action in the small claims court.

    Also, hate to say it, but you may need to check to see if your bank has recorded any adverse credit history against you.
