    might be worth a try as we had already paid some of this off a few years ago but the company that we were paying it to were not transfering the money back to BOS quick enough so they lost the account, so I have absolutely no idea right now how much we actually owe. If I remember right on the Nationaldebtline website it says that if a company sells your debt on then they must inform you of this which hasn't been done. Will let you know how we get on.

    My debt with RBS have been transferred to 8 different debt collectors, I wonder what the chances of them even having the paperwork are now??

    I sent the letter you recommended and they cashed the cheque on 17th May and they still haven't sent any documentation. They continually phone every morning although I don't answer and they never leave a message on the answering machine, I presume that this is because they can't try to intimidate an answering machine so any ideas as to what I should do next?

    Do I wait until maybe the 24th in case the cheque didn't clear in their system until after the 17th and then if I hear nothing report them to trading standards?

    Any ideas what their next step might be, the phone calls are really annoying, I am really tempted to answer and tell them they've got the wrong number.

    You do realise that if you tell them to stop calling you they have to stop or they are breaking the law. You can also request they remove your numbers from their system and only contact you via letter, and if they don't then they can get their wrists slapped.

    I sent out 30 such letters recently, still waiting for replies. I know it's tense but give it time :)

    Just noticed this comment - laws are different, but in England debt collectors have no rights no remove any goods from the house either. Only a bailiff can do this, and even then only provided they have gained peaceful entry to the property first!

    Though i'd heard the last of this lot but no. They never replied with any paperwork and have heard nothing from them in the last year until today.

    Just had a card delivered with my mail from a company called Power 2 Contact LTD stating that they will be calling on wednesday to discuss the recent communication from CSL which turns out to be Credit Solutions.

    Any advice as to what to do. It's in my husbands name and he'll be at work on wednesday. I was going to email them and tell them that I have had no recent communication from CSL and that I sent them a letter last year asking for proof of any debt owing to them and they have never replied.

    How does this work legally, I sent them the £1 cheque which they did cash but never returned any paperwork.

    Can I tell them not to send anyone out as I really don't want anyone appearing on my doorstep?

    I doubt very much if they will turn up, but if they do, just don't answer the door. They cannot force their way in.

    Did you send the letter recorded?

    If you are sick of the phone harrassment, this thread here goes through how to get them off your back and insist they use letters in future (which are legally admissable unlike phone calls). As the laws are different in Scotland, read the nationaldebtline article about harassment, in case the suggestion on the other thread isn't relevant to you.

    I believe they have to take you to court to apply a charge on your property, so you are not there yet by any means

    Re-reading your post, I think you should also send a letter to the Credit Agency along these lines:

    Sort Code – xxxxxx


    I wrote to you on the xxxxx (letter date) asking for some relevant information.

    I enclose copies of the letter which was sent via recorded delivery. I note you cashed my cheque on xxxxx but failed to supply the requested information.

    I am now writing to repeat my request for the information as I have clearly paid for this.

    Should you fail to answer my original request within 7 days I will have no choice but to escalate the matter to the relevant authorities including the Office of Fair Trading and the Information Commissioner's Office.

    Yours faithfully

    Mr & Mrs One

    Send this letter recorded and please follow it up if they don't respond - you should have jumped on them when they failed the first time.

    Should they not respond in 7 days, you must followup with the following:

    If they still fail to respond, report them as detailed. They cannot legally enforce a debt where they haven't provided the credit agreement as you don't know if they are still responsible for collecting this debt.

    The thing is they haven't contacted me at all since last year until I got the card this morning. Don't know if I should contact CSL and tell them that I gave them the chance last year to prove I owed them money and as they failed to reply within 30 days they have no right to pursue me and if continue I will make a complaint to trading standards.

    Could I email the company that is due to visit on wednesday with the same information and ask them not to visit but to keep all contact via letter. Can I do this?

    Any body who has read any of my previous posts will know what I think of CSL, on the phone they are rude, threatening, un-knowledgeable, and generally horible people to speak to, they will not listen to reasonable requests for re-payments (backed up by SOA) as well as making several breaches of the DPA, (discussing my account with non other than my supervisor at work) I have made it my mission to make their lifes as misserable as they are making the wife's and mine.


    if you have sent of the CCA letter and they have not got back to you in the requiered time scale, follow the next step (not sure where it is but it's on here somewhere)

    the 12+2+30 days for me were up last tuesday but havn't been able to take the next step as I have been away, i'm sending the next letter today to see what they have to say, fortunitly the calls have stopped.

    I can see that I'm not the only person to have dealings with them, we all need to stick to our guns and if we say we are going to report them we need to do it or they will get away with it and maybe next time they will pick on someone who hasn't got the help and support of all the wonderfull people on here
