Help - Who has to pay for flood damage to my ceiling

    Exactly the same thing happened to us in our flat. On going for 3 weeks, they kept telling me they had told their landlady.

    I emailed the management company for the building after getting Knowhere who contacted the landlady and the landlady called me the same day.

    She paid for the work to be carried out herself as she didnt want to go through the insurance.

    It depends where the source of the leak is. If it is within the area included in the lease of the upstairs flat then that flatowner is responsible for fixing it. He can either pay for it or, if the cost of doing so is more than the excess on the insurance policy, he can pay for the excess.

    Although I think it is scandelous that the LL of the above flat is ignoring contact, there is no point in you having repairs done if the problem persists!

    it could be that the landlord has told the tenants not to use the shower until the problem is fixed. The tenants may not be listening!

    Not communicating with OP but could be communicating with the tenants.

    Going off the OP's original comment the tenant stated he/she had communicated with the LL regarding the situation and had agreed not to use the shower until the problem had been resolved but has it been resolved? As the leaking problem started again....and the question to be asked is why the LL is not communicating in any way, maybe because they don't want to have to pay for the damage to the OP's ceiling?

    Like I said, absolutely shocking behaviour and certainly not a good example of a good LL nevermind a human being!
