Nationwide Credit Card - ppi reclaim

Hi
I recntly requested a refund of PPi from my Nationwide Credit Card for being miss-sold the policy due to self employment / existing medical condition they didnt ask / mention.
They have written back telling me that, if I was self employed I can still have this policy but I will need to provide the following to be entitled to claim for unemployment benefit:
Satisfactory proof that I have involuntarily ceased trading because I couldn't find enough work to meet all responsible business and living expenses and have declared this to HM Revenue & Customs
and
Are registered as unemployed wit the DWP.
As mentioned above, providing I comply with the t & C's insurers would be able to consider an unemployment claim for me. In addition I would have been given the summary of cover and policy booklet would have been sent to me which show the pre-existing condition exclusion. However I would have still been able to make a claim if I had claimed for a disability not related to any pre-existing medical condition that I may have had at the time.
Therefore, they say, they cannot agree I was miss-sold the policy.
I dont recall ever having such a conversation about any medical conditions, I felt it was compulsory to accept the policy and if I did have any booklets or paperwork I dont have them in my file now! I know for sure it was pre-existing.
I was self employed working for my husband, who is still self employed. However due to the worsening of my health from a condition of my spine I had to stop working. I informed the relevant departments obviously and I now only receive my husbands Tax Credit entitlement and my Incapacity Benefit, as I am and cannot seek work.
So I cannot prove that the company has ceased trading as it hasn't its just I left due to a pre existing medical condition which I wasnt asked about at the time of accepting the policy.
Is this just them calling my bluff or is this end of the road?
What, if anything, is my next move?

Hi there, how are you?
Right this is just a standard fob off response.
Even when I had mine with lloyds tsb in 2001, it did not cover me for everything and they had their own autmated cross in the insurance box, not done by myself. The FOS ruled in my favour, even though lloyds state as an homemaker just on benefits that I would be covered for life cover, hospitalisation, and job solultions, the FOS seen this did not cover me for everything and I was still paying out full cover for it and besides it was not discussed to me either.
At the end of the day, you still have your reasons, keep at them, write back to them until you receive the final response, they should give you details of the FOS in the final letter.
Give it another go.

Write back and tell them you want this complaint reconsidered, refer to your first letter, tell them you stand by your reasons and believe you were mis sold this product because of those reasons on your first letter, you could use the 2nd template to help you, think there is one on the link here for the 2nd stage letter, have a look just in case:

When you do receive the final response, and your not satisfied then take to the FOS.

Just sent another letter thanks. Reguarding reply though how do I know if it is a final response?
