MBNA have not responded to any of my letter's,all cca request,12 + 2, SAR non of them,
so thinking of forcing them to respond to me by sending a letter along the lines of

Dear Sir/Madam
reference the above account, due to the lack of responce to my cca request and a subject access requset i must presume that there is no such account on your system that is recognised and so no outstanding balance and there will be no further communication in this matter, if this is not so could you advise me of your course of action to satisfy my earlyer cca and subject of access requsest

thankyou for your time in this matter

If they haven't responded to any of your other letters they I don't think this one would "force" them to respond.

But if you do send it run it through the spell check first

Don't count your chickens with MBNA, they might well come up with a doctured CCA. How long have you been waiting for CCA ?

Yeah I am in the MNBA fan club !!!. They did supply me with a CCA took them about a month. So far have not paid anything for 9 months and they have just put it with Debt Collections & Recovery . Which is another arm of MBNA.
In your case have they cashed the money you sent for your CCAs & SAR ?
Most people send POs for this.Did you send the request recorded delivery?
I have heard that a lot of folks suspect that MBNA cut and paste a lot of agreements, hoping to make them look enforcable. So if you do get a CCA back from them, have it checked out carefully.

They have 40 days to comply with this before they are in breach of the data Protection Act.

Did you send it by recorded delivery?
Did you include the £10 fee?

If so then you should write an official letter of complain to their head office. Inform them they have 14 days to respond before you report them to the Information Commissioners Office.

If you sent the £1 fee with the CCA request (recorded delivery?) and have not heard anything back, even after sending the 12+2 day letter - then you should report them to Trading Standards for not complting with the Consumer Credit Act.
