    Update : Got home to a letter from HSBC today regarding the account that was closed prior to July 2001 (December 2000)

    It says "Under the FSA waiver, the bank has been required to hold all information from the commencement of the court case on 27 July 2007 and going back 6 years from this date.

    As such, the bank was only required by the FSA to retain information from 27 July 2001 onwards.

    Unfortunately, your account was closed before this date and therefore we are unable to register this claim"


    ????????? What do I do now???????? No mention of the Ombudsman at all
    Is my next step the Ombudsman, I have the statements:D

  • I think the two accounts have got crossed wires with my post. The account closed in March 2003 is certainly one you can claim for since July 2001 as per the FSA Waiver conditions. However, the account closed December 2000 is outside that time period so I would agree on that issue re the account closed December 2000.

    However even with the account closed in March 2003 I would say you do not have a case for Financial hardship but you can claim the charges back to July 2001.
    I hope that makes sense. That is specifically with regards to the FSA Waiver on Bank Charges and the situation as it stands today. However, keep those old statements for the conclusion of the OFT test case.

    I intend to keep the statements,:jyou never know

    At the time we did have priority debt arrears and it caused a great deal of difficulty but that is sorted now.
    The rules on financial hardship are not clear cut, I wish they were as the rules just state that "if you cannot meet your financial commitments"!!!!!

    I will wait to here on the other account which has been passed to a Guidance Team !!!!

    Just wanted to say a huge TA for all your hard work on here, this place would be worse off without you :T

    I worked for the bank whose username I am, and remember receiving a letter about bank charges. At the time I believed the person writing the letter was a "chancer", I followed the processes in place and we refunded them charges. To me that wasn't right, there was no bank error and it quoted legal jargon. I got involved and the more I learnt the more I knew that being a customer is about profit and loss. If there are failings caused by people from above then branch staff got sacked as being their fault when maybe 6 months earlier they would have been praised. Unfortunately, the old adage of "read the terms and conditions" doesn't wash or you are bad at budgetting(well if the bank charged a fair fee then maybe there wouldn't be people who were poorly budgetting). I had better get off the soapbox otherwise I will be proposing a solution to the world's problems ;)

    Sorry not quite sure I understand, HSBC at the time of us having our accounts really pulled some aweful stunts...........................withdrawing OD's, no notice.....................................Buffer zones, no longer available, no notice................................OH wages cheque, no longer being able to be drawn on straight away, no notice..................the list goes on, these things incurred the charges

    Yes I am bad at budgeting, and being firm with OH, I am learning but in my life's journey things have happened which have been made worse by their treatment.

    I have no priority debts because I vowed I would never let that happen again ;)

  • Their recent trick was managed loans for those who are in financial hardship..stupid idea really, more borrowing to help hardship...

    They said in their letter (on the March 2003 account) that they will review our financial situation and devise the best course of action for us !!!!!!!!!!!! I nearly chocked on my tea, the managed loans don't surprise me. When we were with them we were given no choice but to consolidate OD, Loan and credit card or pay OD back....................this OD was used to visit my OH's mother when she was seriously ill in hospital. We had been with them for 15 years at this point and they would not let us continue with a OD past 3 months, even though dear MIL died. We had no money to pay off OD within a month so we consolidated. 3 months later we left them and 1 month later we were late paying the loan and it went straight to their collections dept. Since 2003 they have marked our credit file, every month, with "Gone away/Absconded" even thougth we have paid over half back. So you can see, they didn't offer to help back then, I don't want their help now, I have a very low opinion of them as a bank
