Hi, I have been charged a lot for the past 18 months with capitol one for late payments, but the charges have been £12 (what is apparently considered fair).
Should I bother claiming?

However I read Martin's summary and it said the following...
''Even the OFT says credit card fees are unfair
Not that many realised then, but a report in April 2006 by the Office of Fair Trading (OFT) was crucial in supporting reclaimers’ cases. Having investigated credit card charges the OFT said, in plain language, that it would not launch a specific investigation on any card companies with charges lower than £12.
While the OFT ruling had no technical power, across the board, most card companies reduced their charges to this £12 level. This was of course a positive step but actually this figure, in my view, is still too high as the real administration costs are usually little more than a couple of pounds.
Yet it certainly has made it a lot easier to reclaim back the difference between what you were charged and the £12 figure. So for each £35 charge, you should get at least £23 of it back; though many people actually get the whole £35.''
Is this not the case and I am entitles to it all back?

In Google UK, put the words as written OFT842. Click the link open the report on default charges from April 2006. Read paragraph 1.14 of that report. What do you think it is telling you in plain English about the charges on Credit Cards?0

Thanks again for your reply. I have clicked the link and read what is said. But the fact remains that many people are getting their charges back (apart from £12 on each charge), but if my charges are only £12 each time to start with anyway... I just dont know what to do.

OK, the above is what I was asking you to do(first link is the report), and below is the answer
"1.14 It must be stressed that this is a statement of our position and reflects the exercise of our discretion as an enforcement agency. Only a court can decide finally whether a term is unfair, or at what level default charges should be set to meet the requirements of the UTCCRs. It should be kept in mind that other enforcers may apply for injunctions under the UTCCRs and that the UTCCRs may be relied upon by consumers in private claims."
What does the bit in bold suggest?0
