faulty car

i bought a new car in oct 2008 as of today the central locking has failed 5 times and its going back into the dealership again today . i no longer trust the reliability of my car nor the garage as they have supposedly fixed the fault on the other 4 times its been in for repair. the garage even fail to keep us informed of whats happening to my car when they have it . today my car will go in for the 3rd time in 6 weeks iv'e only had my car for 3 of these weeks. they only provided me with a car once which they hired and was filthy inside that i had to put something on the seat due to stains. i asked them for head office detail and was told they did'nt have one ...i eventually found it through contacting volkswagen directly.any one knows what my rights are ... i asked them to take my car back and they offered me more than £3,000 less than i paid for it i can't even trade it in as its faulty... its only done 1,200miles :mad:

  • Tbh a central locking fault is one which I think a repair is just.

    You can complain but tbh after almost 9 months I think expecting it to be replaced or fully refunded as new is a lot.

    A partial refund or repair seems a just remedy under the SOGA to me.

    What is the exact fault and why does it keep reoccuring.

    Your other option may be to get it repaired independently then chase the dealer for the repair bill.

    When did you originally put the car in to be fixed?

    So you bought a new volkswagen in Oct 2008 ... from a Volkswagen garage ... it keeps going wrong .... have you called HO??

    I think you need to make a fuss ... maybe it is worth you going to see Citizerns Advise ... or do you have legal insurance on car / house .... maybe worth contacting them ....

    I guess it is still under warranty .... what does that say about car hire .... I would suggest that you should be pushing for some form of compensation ... maybe free servicing for a while ....

    I would suggest writing them a strongly worded letter, saying how disappointed you are with car & the lack of info from them, say what you want (free servicing for a year / 2 years), copy head office in ....

  • I agree it is a bit late now, but try Consumer Direct. They are quite good with things like this, at least when advising whether it is worth pursuing. Filling in the online form on their web site will bring a quick call from them to discuss it. Last time I tried my local trading standards they told me they had closed down because of lack of funding (a lie).
    I would also post the name of the garage on here so people can pick up on the thread in searches. Don't be scared of the dealer - always stick to the facts though.
    I have had many problems with new cars -and it is always the manufacturer who puts things right eventually, the dealers are only bothered about profit and targets.
    The two most serious problems were with two different Rover Dealers in Sheffield. (happy days).In neither case were the dealers willing to do anything - but Rover eventually came through to avoid further bad publicity.
    So I would only deal with Volkswagon and if at all possible take it to a different VW dealer.
    Companies I have had problems with -
    Time; Evesham; Gordon Lamb; N.Power; Safestyle; Lycos; Daum; Consumer Voice/CCB Fastmap; BT; Chard, Homeserve (plumbing insurance that solves your emergency but leaves you with the initial problem); Sony.
  • You haven't mentioned how it was paid for, but if there was any finance arranged by the garage involved, it is likely that the finance company will be partially or totally responsible and they definitely need to be made aware of the problems.

    I would agree that a full refund is probably unlikely after this amount of time, a lasting repair, replacement car (maybe, not necessarily for original full price of yours though) or partial refund will be a more likely outcome.

    Can't advise on what to do about anything warranty related because it will depend on the T&Cs of the warranty. If you haven't already I would write to the garage with a copy to HO listing the problems and saying definitely what you are willing to accept, with a deadline for response initially. Depending on the reply, you may have a few different options after that.
