Halifax refuses to pay put under hardship rules

Hi, I am new to this site, I wrote to halifax asking them for over £3000 back under finanical hardship rules and enclosed my financial statement only to get a letter from them saying no they are not paying out and that they are allowed to use my benefits and to ring them to see if they can help me not to occur any more charges.. what do I do next?

    They sent me Obudsman leaflet I am totally lost now what to do next can anyone help?

    they are not allowed to user your benefits .. they told me they could when i was with them till i faxed them the bit that said they couldnt they begrudiginly gave me back my money

    i would suggest you open up a basic account else where just for your benfits and then you just transfer a set amount into your halifax account each month that you can afford

    why did they refuse ? you could try the fso but im not sure how far youll get

    halifax are terrible when it comes to fees still charging £39 a transaction

    It says In your letter you stated that you rely on mean tested benefits and this has been set by the government as the minimum amount of money someone needs to live on.
    In response to your concern about that the fees having been deducted from your Social Security Benefits. The Social Security Adminstration Act 1992 does not prevent a bank from apllying fees to a customers account when they have insufficent funds to cover a payment they have asked us to make.

    That is what they said in thier reply to my letter asking for my fees back under hardship rules.

    you need to write to them and request that they allow you to have access to your full benefit every time it goes in .. theyll ask you to agree an amount that they can keep .. mine was £10 a month
    but as i say i perosnally think you would be better of with a new bank account that isnt halifax
    or open a post office account or ask for giros

    Thanks robpw2 I want to get the money back off Halifax I will give them a ring later to quote the social security administration act 1992 chapter five which says they are not allowed to use my benefits for charges ( i found it on another thread here) and see what their response is to that

    Please can you explain the finer points to this. If it what the OP has quoted under your post then unfortunately that is wrong. I am now intrigued.
    I agree with what you have said re account elsewhere, plus First Right Of Appropriation which I can see you have used yourself.
