Bank charge reclaim

Hi all,
It seems like a life time since we put in our claim for unfair bank charges, and when we put the claim in it came to around £3000. We are still waiting!!!
Anyway, my OH became ill in feb 08 and as a result wasnt able to work for many months. He went back to work when fit only to get made redundant 6mths later, no unemployed. This had obviously had an effect on our finances and we are now looking at filing for bankruptcy.
Natwest will be one of our creditors that we go BR with.
Are we still able to claim the charges back even though we will be BR?
Surely the charges would still be illegal despite us being BR?
For the record i first banked with natwest when i was 16, it then became our household joint account for many years. I have to say natwest have been the most incompetent and obstructive bank ever. They are arrogant and think they have the right to treat people with no respect at all. I dont think they have ever been helpful to us, and have watched us get further and further in to debt. We tried to come to some arrangement with them to pay off our debts but all they could offer us was to take out another loan, which personally would not have helped matters. Not at all the actions of a bank that advertises themselves as a helpful & responsible bank.

If someone could help with my questions prior to my rant it would be much appreciated.

If you go bankrupt prior to any bank charges claim then any amounts claimed is unfortunately part of the amount that is due to your creditors. Have you explored all charges on all accounts and the amounts?
Are there any credit card charges?
How much are the bank charges since July 2001?
Did you have any PPI with any accounts that you could claim back?
Have you already made yourself or been made BR? If YES to this question then I would ask the OR for the bankruptcy.0 -

We are going BR very soon. The claim was put in along time ago prior to the stop on claims being processed. Technically we have put the claim in a long time prior to BR.
Re: credit charges - there were some OD charges
No PPI. At the time the claim went in total charges added up to around £3000 from July 2001.

Credit card charges are reclaimable
bank charges are reclaimable however if they form part of the bankruptcy then any money gained back would be part of any amount owed to your creditors.
If it's natwest did you have loan protector or mortgage repayment protection?
they could be claimable.0
