bank charges court case stayed

can someone please advise, my bank charges case was put on stay by the judge in November 2008. this is till the 30th of june 2009, the letter states that i have to instruct the court of what i wish to happen by the 31st July 2009. or the case will be struck out.

why is the date different by a month ?

do i have to ask the court to put a further stay on it while we await the outcome of the OFT court case>?

not sure how to do this i guess its filling another cout form in..

any advice

    Telephone the court and tell them that the case is stayed pending the OFT High Court Test case outcome. That you still want it stayed unless the OFT Test case issues have been resolved. Ask them what you need to do to keep the case live and stayed.

    Yes, but phone the court first and then confirm in writing. Some courts imposed an indefinite stay ie until the outcome of the OFT test case and any subsequent appeals. Others, as in your case, stayed cases until a particular date. Some of these have automatically extended the stays at the end of that period, but I have seen 1 or 2 examples where cases have been struck out because the claimant, understandably, assumed the stay would be extended and did nothing
