    I was certainly not suggesting she admit she owed anything.

    But it would do no harm to point out that it would be pointless to pursue her for money she hasn't got anyway. If she merely argued about the rights and wrongs of the debt, they might get the impression she does still have the funds and be encouraged to press harder.

    ok great advice, thanks, I will tell her to go to the CAB and get their advice.

    I hadn't even thought that by saying she couldn't afford to pay it back was an admission of anything.

    I really hope she doesn't have to pay this back as I see it, surely there is some sort of timespan on trying to rectify a mistake?

    i would STRONGLY suggest not doing anything until professional advice has being sought. Margaret clare hit the nail on the head, as soon as you say you cannot afford to pay you are admitting you are liable.

    Slow down, speak to CAB and take it from there.
