help with resigning whilst on sick leave for stress

Sorry if this has been answered before but I don't know to go for advice.

I have been working for a very small company (to do with occupational health!) and a manager that I have to work closely with constantly nags and nags for me to do things that are not urgent. for example - doing the bookkeeping and VAT returns and all I get from her is 'have you ordered this from the stationers', 'have you got me this form out' etc etc - all important but not at the time and she is capable of opening a filing cabinet herself!
when you get this (there's only 2 of us in the office now) all day it really drags you down and you end up jumping from one thing to another and not really getting anything done but getting extremely stressed out as you then have the other manager asking why this is not done and what have you been doing all day!
anyway..... they pulled me about how my work is not as good as it used to be and I tried explaining that things were getting on top as I didn't have quiet and time to do them. this resulted in me going home upset one day and them offering me time off. I said at the time i didn't want it but then the next day when back in work asked if I could take annual leave.....3 weeks later I was allowed 4 days annual leave. i feel sick and go to pieces just at the thought of going back and have seen my GP who has signed me off for a month with stress and anxiety. Last week was my first week off (the week before was annual leave) and all they have done is text me and phone me. i have asked them not too but they say 'well there's things we need to know!' I have just been offered a new job in a totally different sector and I have accepted it - but need to know if I can resign whilst on sick and if I should state the reasons that I can't go back and work notice - I have to give a month's notice but still have a sick note for this week and the next two weeks.
I don't want to screw up my chances of a good reference and Im fine until I think of the place I currently work and I go to pieces. I hate confrontation and just want to go quietly but hubby is insisting that I should tell them the real reasons.
Any help / guidance would be greatly appreciated.

    You can resign whilst you are off sick. I think you might need to be signed back on, before you can start your new job, but that depends upon your new employer, and whether you mention that you have been signed off beforehand.

  • these things are not in my JD and the manager in question is lazy and has been sacked from 2 previous posts for harrassing colleagues.

    Mentally I am fine until i go to this place..... i have held far more responsbility in my lifetime that a lot of people my age..... i don't take kindly to being called an emotional wreck - maybe you need to get in touch with real people and not keep slating people who have come her for advice:mad:.

    Getting another job is the easiest way out and won't affect your cv so much. Hand in your notice and make sure your sick note covers all that time if you don't want to return. Your doctor should sign you off again for a further week if you say you are quitting and have already found another job. Working somewhere is much better than trying to battle against idiot managers. It also wouldn't be wise to start the new job before notice period and sick note has expired for the other one.

    If they want to know things then too bad. Tell them you will not take their calls or answer their texts. Any communication must be written. If they ignore it then tell them you consider it harrassment and you will take legal advice. They'll leave you alone then if they have any sense. Then put together a handing over document of things that only you know that your successor will need to know and pass it on to them before you actually leave. You've then done everything reasonable.

    Hi OP

    Accept the new job, hand your notice in and make sure the letter that you write to them is very pleasant. Say that you enjoyed the work and that you are sorry to have to leave. Your first priority is trying to protect your reference.

    Then, when your sick note is up, either go back and put the actor's face on and be perfectly lovely for the week; or get the last week signed off as sick again.

    If the new company ever ask, don't lie but don't forget to mention that your manager drove you out by their incessant demands, and that they had previously been sacked from 2 previous posts and this made you also lose confidence in THEIR manager's ability to pick and manage good staff.

    You can be assured your current employer will say in a reference that you went sick as you could not handle pressure at work.I think the reference will be even worse if you suddenly resign.
