O2 18 month contract, upgraded on 16th month...

Looking for some advice here..

I was on an 18month contract taken out on 8th February 2008.
On the 4th of June I upgraded this contract to a 1 month rolling contract (of which it states in the T&C's I can give 30 days notice at any point to end the agreement...

8.2 "This Agreement may be ended by either you giving at least 30 days' notice in accordance with paragraph 7 of the General Terms. You must pay all the Charges incurred during the Agreement."

I've just called to give my 30 days notice and they've stated that if I end the new agreement now, after 30 days I will be reverted back to my old agreement for the rest of the old contract.

Is this allowed? I'm fairly sure, upgrading to a new contract is effectively ending the old contract!

    With most networks when you upgrade early the number of days that are still remaining are added on to the new contract term.

    eg/ If they let you upgrade from an 18 month contract to another 18 month contract 47 days early, your new contract will actually be for 18 months and 47 days, or to put it another way, 19 months and 17days. Meaning that when you decide to cancel you can only give your notice 30days from the end of the 19months and 17days period.

    As you only upgraded a few days ago the network you are with may be taking this as a change of mind and reverting you back to your old contract as this is what they would do if you had chosed a phone deal that you had decided that you didn't like.

    I'm no expert but i think your probably going to find that in the terms and conditions of an early upgrade that they are well within their rights to enforce the full 18months that you originally signed up for
