Barclays Delaying Paying out?? - financial hardship

Hi guys / girls, my first post on here so here goes

i have been trying to claim back £1200 from barclays under the hardship rules, and have today recieved the following letter

"i would like to update you on my investigation into your complaint,
we are not yet in a position to provide you with a full response, when we recieve the information reqired from our consumer finace debt managment team we will write to you again"

it then goes onto say i have the right to cotact the FOS, should i do this or should i wait and see what happens?

    Hi, that means it is going in the right direction. Barclays can take up to 20days from your first hardship letter to pay out. Good luck

    sorry should have mentioned, this is the 2nd letter they have sent, the first said it would take 20 days to look at my claim, the 20 days was up friday and i recieved this letter today

    First post here, so hoping you dont mind if i ask similar question to everyone else....I sent barclays my first hardship letter on 26th May, got a reply on 4th June which has totally confused me, so hoping someone can help.....first para states that they are currently assessing my claim and i will advised on the outcome as soon as possible and gives me a financial difficulty claim reference number.... It then goes on in the last two paragraphs to tell me that they until the determination of the legal issues in the OFT and Banks proceedings they have suspended the normal timetable for dealing with complaints, and that that once the legal proceedings have been finished they will then resolve my complaint......
    Could any of you who have received a goodwill payout, please advise if this is their standard letter, or do i need to send them another one reiterating that I am in financial hardship...thanks for the help....

    Well I put a claim in with Barclays last year - also mentioning hardship. That seemed to be ignored - and I was put on the general wait (court case blah blah blah). Anyway after reading here about going the FOS route for hardship I thought I may resurrect the claim (as the court case keeps getting delayed every 6 months). Had quite a quick response from FOS. They acknowledged claim and then about 4 weeks later - returned all my documents saying they had written to Barclays on my behalf and need to wait for a final response for Barclays before resubmitting. Within a week I have had 2 letters from Barclays informing me they are looking into my claim and passing to a new department. And that is where I am at at the moment. I am not sure what the FOS letter to Barclays said - but the ball seems to have started rolling again - in a positive direction I hope. Anyway - so my advice would be - go to FOS claiming hardship (see guidelines on this site), and hopefully it will all swing in your favour.

    I gotta say this, I don't agree with what is on the Hardship guide with regards to going to the Financial Ombudsman Service because it seems to suggest that the Banks' will automatically pay out if you take that route. That is very questionable to be honest. If you haven't asked the bank to relook at your case then what the FOS do is take details of your complaint and send it to them for them to give a final response before they look at the complaint rather than if you go to the bank directly first. I think, luckily for you, that Barclays will indeed come up with an offer or payment becuase at the moment they are paying out a lot. However, please remember that the bank is highly unlikely to offer 100% of the charges back.

  • This is my first post sorry if I waffle on ...
    I sent my claim letter to barclays on 1st may and within 2 weeks I recieved 2 letters one of which was 4 pages long gabbling on about court case etc and 2nd letter said sorry to hear about your financial hardship fill in this form which I did and got a response within a further 2 weeks. It said you will be pleased to know that we are looking into your hardship claim and may need to contact you for further details but I should have a response within 10 days. Its now 14 working days since that letter and I have rang them twice the 1st time (on 10th day) I was told my case is being reviewed and a letter is on the computer waiting to have the blanks filled in (her words not mine). Then today (14th day) my case is still being reviewed no decision made as yet but due to large influx of claims its all getting back logged and should only be a couple of days more. Told them if I have not heard from them by friday I will seek legal advice.

    Thanks for response - it is so hard to know what is what as there are so many different stories - and unfortunately I only know one side of the story - mine. In all honesty we are a genuine hardship case. My husband and I both work but unfortunately our income falls into that middle ground where we earn too much to be considered on low-income and not enough to cover all our bills - we don't get any benefits or utility reductions - so despite us both working 5 days a week we are a lot worse off than those earning less or not working at all - go figure). Anyway I am just impressed with the speed of the process at the moment - I have a PPI claim with FOSwhich is now 15 months in and counting. I am not sure how the bank will respond - but I am hopeful - it would make a big difference to us as a family!! I really appreciate this forum and all the 'case studies' which make understanding the claiming process that bit easier. :rolleyes:

    What utter rubbish, how can you possibly be worse off than people receiving benefits. :confused:
    Hang on a minute though we don't receive any benefits, we both work our butts off for at least 5 days a week, have put the kids through private school and now through uni, and we have no money. Heavens above you were right after all.:T

    What I would say is to have a look at your income and expenditure, so for example, have a look at gas and electric savings that can be made by switching, and see whether there is any room for cutting back on certain things that could be seen as a luxury.

    I submitted my I&E to barclays on 23 April and was told 20 working days - 22 May I was due a response. I got it on June 4 (and the refund two days before) - they are currently taking six weeks, simply due to the volume of complaints.
    No Longer works for MBNA as of August 2010 - redundancy money will be nice though.
