Halifax On Going

I have just sent a letter to my bank after they sent the usual letter stating that their charges are fair and that they are awaiting the outcome of the test case.
I have just sent another letter by recorded delivery informing them that if they do not repay all charges within 2 weeks i am taking them to the small claims court. I am not going to settle for nothing and will fight them no matter what it takes. Given the fact that my banking now is in a mess because of the whacking great charges they have hit me with. I have had to stop all direct debits going out of my account thus incurring even more charges. I am overdrawn so now have no access to do my banking.
I went to another bank to open an account and was asked did i have another account with another bank? Well i had to be honest and said yes. They have asked me for a statement to open an account but as soon as they see the previous bank statement they are not going to give me any account. I have applied for a basic account to make sure my direct debits get paid. I have also contacted these companies to see if there is any other way of paying them rather than through direct debit or standing order for the time being.I have told my bank i am claiming charges from that i am not going to put any money in the bank, and will leave the overdraft as it is until they have sorted this mess out. In the first place when i was overdrawn i was able to clear my debt which i did but then they hit me with charges and this has just snowballed. I also put money in the account to pay a loan of theirs and instead of that loan being paid they took this to pay their charges. I am being charged now for charges and it is getting worse by the week. So i have now issued them in writing that they pay back everything or i will take this to court. How are banks able to get away with this..

  • If you take them to court the claim will be stayed pending the decision of the OFT test case issues which are still ongoing.

    So why is it then that so many people are attempting to get these charges back a good proportion of which have received payouts. But my bank has paid nothing and took everything. So it means that i have to sit around and wait while the bank takes the P and continues to charge??????????? while this test case goes through? What year are we talking about 2012?:confused:

    People are reclaiming under financial hardship.
    That in reality means priority debt arrears(mortgage/rent, utilities, council tax).

    I got a bank charge last week for going overdrawn by 70p ! £35 charge for 70p, apparently they are allowed to charge so much and im not getting it back. Have tried to get it back but nope =( Any advice and also how can they still be charging so much !?

    First i hope this is in the right place
    Second a big thanks to all as today i recieved a letter from Natwest offering me £2861.00. I can't believe my luck as today my mortgage company was starting solicters proceddings for eviction!! wow now i have two months payments thanks to all xxxxxxxxxxxxxxxxxxxxxxxxxx:easter_ba:hello:

    Make the solicitors aware of it so that they delay proceedings while the money is paid to them, does it clear your arrears?

  • Why is it that Halifax seem to make the rules up as they go along? And more to the point how do they get away with it?? And when you call them they are full of a million excuses and attitiude?

    I am so fed up of them they actually reduced me to tears today and that takes a lot. They have charged me £35 today and I haven't even gone overdrawn! I had an argument with the obnoxious call taker who basically told me to deal with it and that they were not going to be crediting the charge back. Their attitudes really annoy me!!

    I have called back this evening and asked for a form to claim financial hardship (I have already sent a letter to them asking for my bank charges back which they have refused and told me to wait for the outcome of the illusive court case) anyway they told me they couldn't send me a form although looking on this forum other banks just seem to send it out. They are getting someone to call me within 5 days to go through the form over the phone? They owe me about £500 from my personal account and around £350 from my joint account. I struggle to pay my 2 credit cards and catalogue bill every month as well as now trying to pay my £2500 overdraft bank as I am moving banks. Does anyone know if this will be enough to claim my charges back under financial hardship? Any advice would be greatly recieved thank you.

    It's not attitude, its the way that bank staff are trained on charges, ie one gesture of goodwill, or if you have repeated charges then they are fair.

    Financial hardship in reality is priority debt arrears(mortgage/rent, council tax, utilities). Have you got charges on the catalogues and credit cards to reclaim?

  • Yes I do have charges on my credit card/catalogue accounts and had to take a payment plan on my mortgage where we agreed with the lender we would pay £300 less per month for 3 months but we used that money to live rather than pay off debt.

    And with regards to your comment about the call centre staff not having attitude - some of them do have an attitude I have spoken to enough of them. Some are nice and helpful though so they are not all bad.
