01/10/08: I sent a letter to Lloyds 8 months ago requesting that they pay all the default charges that have been applied to my account. It was a letter of complaint template from this website.
13/08/08 : I got a reply to this stating how sorry they are to learn that I feel I have cause to complain. the letter harps on a bit and then says.... If your complaint is about the level, fairness or lawfulness of overdraft bank charges, then a different process that we've agreed with the Financial Services Authority will apply. We will write to you shortly to explain how we'll handle that complaint and what steps we will take to protect your rights.
15/08/08 : I received another letter from Lloyds harping on again and then stating ...We believe that our current account fees are clear and represent a fair charge for a banking service that is valued by our customers. However, Lloyds TSB (along with a number of other banks) has now become involved in legal proceedings with the Office of Fair Trading (OFT) in relation to bank charges which we believe will resolve the legal issues regarding the fairness and legality of your bank charges. The letter then goes on briefly about the previous court cases.
09/03/09 : I received a letter stating: In the first step of the test case last year, the judge looked at our current term and conditions and decided that unplanned overdraft charges are not penalties. They are, however, assessable for fairness. The banks' appealed this part of the decision. On the 26 february 2009, the court of appeal held that these charges were assessable for fairness. The banks are applying to the House of Lords to appeal this judgment.
Today 06/06/09 I recieved a letter from BLS collections stating.... We have been instructed by our client, Lloyds TSB PLC, to recover the balance due of £679.18, under their reference number ***********
We would advise you to make telephone contact immediately with your proposals to clear the debt.
Failure to do so may force us to make contact by telephone or advise Lloyds TSB PLC to consider whether a personal visit is required.
If you wish to make a payment today using either your debit card or Credit card then please contact us on the above telephone number.
I have had two phone calls from them today but have told my parents to tell them I am out as I thought it would be best to get advice on here first.
If I remember correctly I were told on here as long as I sent a letter of complaint meaning I am in dispute with the banks and whilst the banks are in dispute with the courts they cannot enforce anything, but I also thought they cannot bother you for money once you have sent a letter????
Any help on how I should approach this would be very much appreciated.
Thanks KD1

Yep, write to them with the reference number(for your complaint with LTSB) and state that as the account is subject to a legal dispute you will only make arrangements once that legal dispute is over. Furthermore, if they ring you tell them the same and that you will confirm that in a letter to them shortly.0

The Office Of Fair Trading Debt collection guidance states:
Dealings with debtors are not to be deceitful and/or unfair (section 2.7).
Examples of unfair practices are as follows:
Not ceasing collection activity whilst investigating a reasonably queried or
disputed debt (section 2.8 k).
oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft664.pdf
I have sent the letters again today so shall see what the outcome is.

What does "miver" mean?0 -
contacting me constantly by either letter or phone0

Write to them requesting that they do not call you and only contact you in writing, in fact, you might want to change your telephone number on bank records to their telephone banking number.contacting me constantly by either letter or phone
Once you have written to them keep a log of the calls and answer every call with "I have asked for all communication in writing". Should they attempt to go through the ID process then deny any piece of information on the basis that you have no idea who they are. ok?0
