New Hip Legislation

Just been told by the Estate Agent, that under new HIP Legislation, if an EA wants to mark a property as under offer, they will have to put the offer on the website, if they dont mark it as under offer then they dont have to do that, as a result they are not marking any properties as under offer.
Not heard this before, and none of the agents, marking properties as under offer, have the offers accepted as visable.
I cant find anything relating to this anywhere, any one else heard this?

    Do you mean that they should put the actual value of the offer? Sounds very strange to me and an invitation for guzumping. Maybe I don't understand.

    Yes thats exactly what I was told, however they dont have to disclose it if they continue to market ie dont mark it as under offer. I cant see anyone, showing the offers, nor can I find any infomation to back this up.

    The only thing I have seen remotely like that is on repossessed houses where the vendor will try to get a higher offer right up exchange of contract. Legally obliged to. I have seen ads quoting offer values in these instances and invitations to bid higher.

    Sounds like the agent is talking rubbish but you never know. I 've had a quick look on the web for you but can't see anything. I am not so up to date on the rules but perhaps one of the currently working agents may help out soon:confused:

    Absolute claptrap!

    What planet is that agent on? There is no new legislation that relates to this and it is nothing to do with HIP's either.
    My home is usually the House Buying, Renting and Selling Forum where I can be found trying to (sometimes unsucessfully) prove that not all Estate Agents are crooks. With 20 years experience of Sales/Lettings and having bought and sold many of my own properties I've usually got something to say ;)

    Closest I can find to this is in the Ombudsman's code of practice; nothing to do with HIP tho'

    When an offer has been accepted subject to contract (in Scotland, conclusion of missives) you must consult and take the
    seller’s instructions as to whether the property should be withdrawn from the market, or continue to be marketed. In the
    latter case, you must so advise the prospective buyer in writing. The prospective buyer must also be informed in writing
    should the seller later decide to put the property back on the market.
    You remain under the legal obligation to pass on offers, as defined in 6a above.
