    I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)

    I now require all further correspondence from your company to be made in writing only.

    I am of the view that your continued harassment of me by telephone puts you in breach of The Consumer Protection from Unfair Trading Regulations 2008, and the Protection from Harassment Act 1997.

    If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

    Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.

    Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

    Hey Toffee Penny glad to hear you're doing ok and still hanging in there, and of course giving everyone great advice:j:j

    Not been around so much lately, life getting in the way I guess, and I got a bit p*****d off with everything especially getting the dreaded CCJ.
    I needed to just take a rest from everything really.

    I'm now trying to catch up with the thread, perhaps I shouldn't be away so long next time, it moves so fast:rolleyes:

    I spoke to CCCS this morning, the lady there didn't think my idea above would be acceptable.

    We have our appointment with a councillor in a couple of weeks time, and will be able to maintain payments to our creditors for the next month or so.

    I think the reason the system suggested bankruptcy was because it would take over 30 years to pay everything back. Can I ask, does anyone have any experience of paying their creditors a token amount of say £5 or £10 a month, with a view to reviewing it in 6 months time?

    We are at our wits end here because it appears we will not be allowed to do a DMP (too long to pay everything back), but we cannot go with bankruptcy due to my wife's job (she'll lose it if she's declared BR - and the income that goes with it.). We have no equity in the house so can't sell it to pay anything off.

    I honestly feel as though we are trapped in a nightmare that we can't wake up from...

    Please does anyone have any ideas/suggestions or even just words of comfort? With a 2 week old baby in the house we are REALLY suffering emotionally, and are just sick & tired of the worry in what should be a happy time for us. :cry:

    Oh Braddyladdy I feel for you I really do but DON'T despair, somewhere in this section of the forum there is a long haul supporters thread. They are lovely people similar to us in the sense they are paying their debts but over a much longer period hence the title of their thread, they might be able to suggest something (from being in similar situations I assume) Give it a try, they are all friendly.

    There is also a bankruptcy forum too and there are many many people on there who will give good advise on your situation if you want to consider this route. However just a word of advise, we too were told 'bankruptcy' was our only option (we owed just over 50k) however I did research bankruptcy and found it isn't quite as easy as made out to be. Firstly if you are unemployed then things are pretty straight forward however if you are working then I am pretty damn sure you will have to make somekind of contribution to your creditors!

    By declaring yourself bankrupt you are saying you have nothing left to pay; no income or no assets to use to pay your creditors. I doubt you will be able to continue working 'raking wages in' and living in your own house whilst wiping your whole debt off. It all sounds so final and I don't think CCCS or the like really explain in detail to people what bankruptcy actually means and how it will affect you in the long run.

    How much is it you actually owe? The reason I ask is one person on this thread had debt of over £80k and chose to do a DMP.

    Bradfordlad, why not try organising your own DMP, ie negotiating with creditors yourself, if you can get your head around this, what with your new baby and all.
    The beauty of this is you can then offer creditors what you can afford at the moment with a view to increasing payments as and when.
    You can still say you've taken advice from cccs to add more weight to your offers and there's loads of great template letters floating around to help.
    A few on here are doing there own DMP's (me included for my OH) so there's also advice not too far away.
    Bear in mind creditors will not always accept the offers you make straight away (if at all) but the key is just keep paying what you can afford on a regular basis, and ignore all demands and threats asking for more.

    Just a quick response to whoever mentioned that being on a DMP was no guarantee of getting bank charges repaid under financial hardship rules, I can vouch for that as we've just been refused, on the basis that we seem to "have enough income to meet all our outgoings".

    Cheers, I've spent the past couple of hours writing a couple of letters to Monument after speaking to them on the telephone today, basically they wanted me to make an extra payment each month without CCCS knowing, otherwise they will not accept my DMP and have said they will telephone me every day until I do. Monument are my smallest creditor at just under £180 yet they seem to be one of the most difficult.
    PPI reclaim will happen eventually lol

    Hi all,
    Just sat down and sent letters to all our creditors notifying them of our dmp, going to send a token payment as well as it dosnt start till August.
    A bit worried as the bank seem to be sticking £22 a week on but the cccs tell me its ok.
    By what ive read on here i shall wait by the leter box and look forward to the small rainforest that drops through it.:o
    Gotta keep on smiling though .
