I've just had some good news regarding my reclaim against Nationwide over their illegal charges. Originally they offered my just a £20 refund, however after a strongly worded letter they have now agreed to refund £830.

It's not quite the £1076 I was claiming but it does clear my remaining debt with them & give me an excess of £130. I wasn't sure they would refund anything until the test case outcome was officially known, but they allowed me to do it under financial hardship which surprised me.

I'll still go after the rest but regardless of whether I get it or not I'm just delighted at this outcome.

Congrats Geoff! I'd love to know how strongly worded letter it was. ;)

I need a bit of advice. I pop along here every so often to read up and to post sometimes. I have a citicard with a large balance on it. I had set up a regular payment with them, that they have accepted last november and now they have passed the debt onto Moorcroft debt recovery. I have heard this company can be bad  . I pay everyone at the begining of the month, so I have already paid citicard this month. Moorcroft would like me to pay them this month as well. Well I just don't have the money to pay them as well this month. Then they want me to pay about a half of what I would be paying citicard, again which I don't have. I said that I would have to get back to them, to see if I was able to pay anything. They then said that I would have to go through the conversation again and it depends on the person that I speak too, to make a decision on how much they want me to pay them as they have threatened legal action.:eek:
I have just phoned them up and offered them the same as I was paying citi, they have declined that and they would like me to clear the debt within 5 years. So that means that they would like me to pay double what I was paying citicards.
Can anyone give me a little bit of advice on what I can do now. I haven't got a lot of money now as it is the middle of the month.

I think Moorcroft can be a bit, er, mean.

I'd speak to them and stand firm, and explain you haven't got any extra cash, hence the position you're in! I guess they're just trying to get blood out of a stone, and will accept, but I can't say for sure, and no-one ever knows if they're empty threats or not.

Either way, they can't have what you haven't got! And there's not a lot you or them can do about it.

    Welcome Yidi.

I'll get a number sorted out for you soon, but please feel free to join in and get involved with this thread. You don't need a number to be able to do that!

    Cheers,

    Ian

    Hi Ian,

It was a very, very strongly worded letter. I must admit I was so annoyed when I wrote it because Nationwide were trying to get out of paying the money back by citing transactions on my account that happened previous to my financial hardship. It's like they were saying I should have known the firm I was working for would go bust & should have planned for it. Anyway whatever it was I said worked because they relented pretty quickly.

I don't really know why i am putting it off!! think i'm quite daunted by the whole thing!!

Could you please tell me where do i start?

is it to apply for 6 years worth of statements to show the payments?

Think I'm going to give myself a deadline to start! or i never will!

    Hiya,

The best way to start is send an SAR request. You can just ask for a comprehensive list of all the charges but it's not worth it as you have to pay £10 either way. You may as well just go for a proper SAR & get all the infomation they have on you which will also include your statements. Do that first to get the ball rolling.

funnily enough I was looking at the HP agreement earlier today. I can "hand it back" once the agreement has passed the half way point. I also noticed that it hasn't been going as long as I thought (typical!). So I'd have to keep paying till March 2010. THEN they could have it back....

Would it be unreasonable to pay off the HP with a credit card? I know I'm only shifting the debt effectively, but at least then there is £190 a month more that could go to the plan?

    Hi again,

I personally wouldn't consider that unreasonable as you are not trying to avoid debt your more trying to consolidate. Usually you wouldn't want to pay off any debt at the full amount as most firms do accept full & final settlements when you are on a DMP, however it's more complicated with HP because technically they can come & take the caravan off you.

If you definately want to keep the caravan then it's worth considering paying it off like you suggested. The only downside is that the credit card APR will be far higher than you are paying on the HP & assuming they don't immediately accept your DMP then that debt will probably rise fairly rapidly.

    Hello Everyone
My DMP to start August with CCCS. Been list-lurking for a while but just wanted to say a big thankyou to you lovely people for the suportive and encouraging posts I have seen last few days for other newbies. After many sleepless nights and losing weight through the worry I feel so much more positive and prepared to deal with what is to come.
DMP to last 19years (will be 74 by then :() so lots of time to learn how to post properly!
Really cheered today by 1st demand from creditor (not in arrears yet, all paid for July) asking for an immediate payment of £0-00 - made me realise my sense of humour still lurks somewhere buried :cheesy:
So thankyou to you all, sure I will be back soon with lots of questions!

    Hi everyone

Sorry I havent been around very much - all day morning sickness and tiredness. Hopefully the phase will pass soon as I'm reaching the 3 month mark in my pregnancy.

Still coming to terms with the "surprise" and just as I'm managing to stay calm about the looming huge drop in salary onto basic SMP, I go into work this morning to find that they are putting us on a 4 day week from August

On the one hand, yay, working 4 days suits me better but how on earth are we supposed to try and save anything now towards the baby fund while I'm on maternity leave?

I wondered whether any of you have changed - while being on a DMP -from a repayment mortgage to an interest only mortgage as a way of being able to reduce your monthly outgoings? I'm sure we're still on a fixed rate until January 2010 with Abbey so I dont even know whether they will consider a request to change anyway - let alone the fact that our credit file is shot to pieces, we've had mortgage arrears during the last 12 months (now repaid though). Will they just tell us to bogoff full stop?! In my current emotional state, I dont think I can cope with a rejection.

I really, really dont know how we are going to cope. Any ideas... please. All I can see at the moment are months and months of more money worries/arrears building because we cant find a way to make ends meet.

    Thanks

We changed from a repayment mortgage to an intrest only with the halifax, when I first rang they said I could only do it if I has investments to pay it off at the end, the next time I rang they just said no problem and did it there and then over the phone, didnt have to give any financial details or anything - they just changed it over on the computor and told me how much it would be the next month, then I got a confirmation letter and that was that. They said I would be able to change it back whenever I wanted to.
