cancellation rights. Distance selling

I bought goods on the internet and very quickly changed my mind and also informed the company. They still sent the goods, which I refused at the door. I have been waiting 21 days so far and heard nothing at all but I kept the e mails going so I would have written evidence. Two days ago I sent a recorded first class latter, quoting bits from the relevant act and lo and behold, they suddenly responded to an e mail yesterday to say that the money has just been refunded
I wait hopefully now, knowing that my tenacity has paid off
Don`t give up on your rights, any of you

Distance Selling Regs - The retailer has up to 30d to process the refund to your card from the point at which you informed them to cancel (in a durable means but check their terms and conditions)
Sounds like its going to plan! So satisfying.......0 -
you also have the right to cancel up to 7 days after delivery and I bet many people don`t know that0

You do have that cancellation right but you will probably be liable for return postage (unless stated in their T&C's).0

Hi Scullster, yes quite often a consumer may be liable for the return postage - but the DSR are clear that unless the retailers T&Cs state that the consumer bears the return postage costs then the retailer must bear the full return costs. As well as this the retailer must also refund the original price of the goods+delivery within the 30 days from the time of cancellation, regardless of where the goods are at that stage.0 -
And please don't assume that a refusal of delivery is all you need to do, best to send a proper letter cancelling the order/contract too to make sure the trader is aware of what your intentions are, as it could be they just get the message that you weren't at home to accept the delivery.Little lady arrived 13/12/110
