Quick question about refund

I've had a product for just over a year, still with another year's warranty.

Have been very unhappy with service and product and they said they're going to fix it ... again.

The last reported problem was in February... they said I will have to wait and see if this gets fixed before I can claim a refund...

Is that correct?

    well it helps to know what the product is and where you bought it from


    but essentially you can ask them for a refund whenever you wish under the sale of goods act and any applicable warranty clauses there may be

    OK, the Sale of Goods Act and warranty rights are completely separate and against different people so you need to pick one of them and go with that.

    If you're going under the warranty with the manufacturer then you are bound to the T&Cs of that, so if it says then you have to have 1/2/568 repairs before a replacement is considered then that is what will have to happen.

    Or if you use Sale of Goods Act rights against the seller, then you would have to argue it isn't satisfactory quality and would have options of repair/replacement/refund. BUT if the manufacturer (or their representative) has been and fixed it once already, then you have reduced your chances of the seller intervening and sorting something out, you can't normally change from manufacturere to seller sorting it out without problems.

    And on a side note, I don't want to sound harsh or out of line here, but have found (generally, not just on this thread) that some advice given can just muddle the situation through not being accurate. Of course people are just trying to help which is the point of the site but it can make dealing with probs more difficult than they need to be. By all means people can offer their advice, and posters can take it on board but it is always best to ask a proper service for advice before taking any action I would think. Just my view!

    Have decided to give the company one more attempt to fix it because a kind CS said that it is "last chance" and then I'll get a refund... There's no way it will be fixed so in about a month I reckon I'll be ok, and will be able to "release" my anger and tell everyone about it!! :)

    tbh if their is a warranty present the i would always argue down that route as it offers much less resistance and hassle then the sale of goods because most businesses make it seem like it doesnt exist and ignore the rights it gives you unless you give them hard evidence of your right and also the reason i didnt go into detail is because you havnt given details of your situation, and because the sale of goods act is up for interpratation in the manner that its protection highly depends on the circumstances of each case.

    warranties are undeniable if they themselves supply them so i just think it makes more sence to go down that route.
