Can i continue with my claim?????

In March 2007 i started my claim with the Halifax, i sent all the appropriate letters to them , with no joy. I got to the stage where i was just about to take them to court when they started doing the test case and claims were on hold.

My question is, can i still carry on with this claim or would i have to start a completely new claim ???????????????? :confused:

    I would start a new claim including the previous charges PLUS any new ones up to today.
    I have not worked for NatWest Bank since February 2009

  • The thing is that most of my charges that im claiming for are between 2001 and 2004.

    Will the Halifax just not say you can only claim for the last six years, although i started my claim March 2007 before the claims were put on hold. obviously not my problem and the money would be better off in my account!!:D

    They may well do, but the FSA waiver says otherwise:
    (14)
    the firm must not take into account the period between 27 July 2007 and the date of termination of this direction (the “stay period”) for the purposes of relying on any limitation period (or periods) or time limits within which complainants must:
    (a)
    make relevant charges complaints;
    (b)
    refer relevant charges complaints to the Ombudsman; or
    (c)
    bring claims before the court;

    and the firm must not otherwise limit any redress that may be due to the customer, when complying with DISP or otherwise, because of the stay period;
