Taken payment, no answer

I know it's a common one, but for any advice before I go to county court please. I will name the company: it's Greenfields Hydroponics in Norfolk. I ordered something a month ago, did not receive, sent an e-mail two weeks ago when they told me they'd be in touch within 24 hours, and nothing. I've sent them warnings I'll take further action and consider them fraudulent if I don't hear. Still nothing.

Any help please?

    Have you tried phoning them?

    Write to them, ideally by recorded delivery and ask for performance of contract within the next 14 days. Whatever you used for payment notify them that the goods have not yet been delivered, especially if it is a Visa/Mastercard debit card and you're looking to do a chargeback.

    I'm assuming this was a distance selling purchase, either by internet, phone, mail order or a TV shopping channel....... hence references I make to Distance Selling Regs 2000.

    In the main, its largely up to you how you proceed. If you still want the item, then persevere with them and speak to them (always ask for the name of who you are speaking to and keep a log of the phone calls). If you can wait for the revised delivery date, then get it confirmed in writing but inform them that if they miss it, or have any doubts at this stage that it will be missed, then you will seek a refund as is your statutory right under the Distance Selling Regulations 2000.

    If you're fed up with the experience, and want to cancel, then you can do so providing the goods aren't bespoke or customised to your spec (just double check their T&C's for cancellation period but you should be okay). Under the DSR, a contract with the retailer can be considered void if they have not delivered within 30d.

    You should be able to clear this up without going to court although it sounds as though you are itching for your day in court.

    Many thanks. I'm not itchy, for court or otherwise, I just want what I paid for a month ago. And when companies don't answer any form of communication, you need to turn somewhere.
