"Write Off" your debt companies

Probably Charlatans (although not heard of this specific company). Or at least offering you a service you do not need. They are overpromising and what they actually deliver will be something you can do yourself for free with the help of the people on here.
They will probably be talking about challenging your consumer credit agreements on relevant debts taken out pre April 2007. You can do this yourself with advice.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Hi Adscams.
This relates to the consumer credit agreement. All credit agreements (loans, credit cards, store cards and similar) taken out pre April 2007 had to have a signed credit agreement with very specific terms included. It is true that some creditors either have lost these, never had them or they don't contact the correct legal information.
If any of these is the case this makes the debt unenforceable in court. It does not mean the debt is written off, the creditor or debt collection agency will continue to chase the debt and report to the credit agencies that it is unpaid.
These companies will over -promise on whatthey deliver and charge you a huge fee. Don't use them.
You can do what they do yourself with a £1 postal order and advice from the experts on here.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Yes, listen to tixy, most of these copanies are just after your dosh! charge a lot for checking, and if they "win" charge you more.
theres only the very odd one that may do it for a true no payment at all.
If the ywere any good ,they wouldnt be ringing you out of the blue !! they would be too busy.
The Office of fair trading , has a huge list of copanies who are on their last warning about this.so just speak to the experts on here and you;ll be quids in ,even if your agreements are good.

There are a lot of these types of companies calling just now. I had one recently offer me an IVA - told him they weren't valid in Scotland and put the phone down. Ten seconds later the phone rings again - same guy goes through exactly the same spiel as if he hadn't just spoken to me but exchanges 'trust deed' for the iva part!!!The person who moves a mountain begins by carrying small stones.

Hi Tixy
I'm doing my own DMP.. aaaand trying to learn more about unenforceable CCAs. (so forgive me for being a dimwit)
If they are still going to chase you for the debt.. and it doesn't mean it's written off.. Then what's the point in looking into it in the first place? Why bother?

You could report them as well, because they are misleading people and a lot of these cases are being put on hold at the moment. I am sure Rog2 Posted about this earlier.Blackadder: Am I jumping the gun, Baldrick, or are the words 'I have a cunning plan' marching with ill-deserved confidence in the direction of this conversation?

This is down to the fact that a lot of DCA's will try and take you to court for the debt. If there is no valid CCA then a court will chuck it out, that is not to say however, that no money is owed but gives you a better negotiation tactic...... If that makes sense? It means that you can pay back what you can afford rather than them threatening you all the time.It is probably better explained on the CCA thread.Blackadder: Am I jumping the gun, Baldrick, or are the words 'I have a cunning plan' marching with ill-deserved confidence in the direction of this conversation?
