Buy-as-you-view PC problem advice please

I bought anAcerpcfrom buy as you view in august 07 and this week the motherboard has died. They are refusing to repair it saying that I do not have an extended warrenty, although they said I was covered at time of sale. The pc is bought on a 3-year Hire purchase agreement and I believe I can use the Sale of Goods Act to make them repair it. Is my information correct or should I just let it go?
Any help is gratefully appreciated,

    If the motherboard has a fault not due to misuse (or non-normal use), then you may be able to claim a repair. You may have to get the fault confirmed independently before they will agree.

    In any event Sale of Goods Act won't apply here as it is a hire purchase.

    Similar rights under Supply fo Goods (Implied Terms) Act 1973.

    Hi Tracy, before you go and start quoting acts you might want to look at your finance agreement, it would be more common to have a loan agreement for the laptop rather than hire purchase. Check the paperwork and see if you have a fixed sum loan agreement instead of a HP agreement - it's important to ensure you know which you have as that governs what legislation you quote and to whom you quote it - but either way the legislation will most likely entitle you to a repair free of charge.

    Thanks for the replies.

    The PC was actually repaired by ACER while under warranty in sept 08, the motherboard was replaced as part of this repair, so would the new motherboard not have any sort of warranty with it. :question:
    I had no paperwork sent back with PC as Buy-As-You-View collected pc and then sent it to ACER and it was returned via Buy-As-You-View.
    Have looked all over the net but can't find answers anywhere and the motherboard manufacturer is refusing to admit even making it :mad:.

    The main thing to say is that if you've already gone down the warranty route then you will struggle (even more than you would normally!) going back to the retailer, it's usually one or the other that gives the best results.

    The only way there will be a specific warranty on the motherboard/repair is that if it is mentioned in the T&Cs of the warranty paperwork. Otherwise, there is still a general assumption that the work will last for a reasonable amount of time, and this specific issue is then covered under the Supply of Goods and Services Act 1982 based on the service not being carried out with reasonable care and skill, and the part not being satisfactory quality. ACER would have a responsibility to ensure that is repaired to a reasonable standard to reach it's reasonable lifespan.

    Would also def suggest checking finance paperwork cos depending on what it is can possibily lead to other options.

  • Have just written complaint letter to finance company and am gonna phone ACER in the morning about the repair they did.
    also going to CAB with HP agreement as I am not sure it is quite right.
    Hopefully I will get somewhere soon

  • we are now getting pc repaired FOC as it turns out ACER did not repair it but a company called VALUETECH did, so we rang them and they said we are still in warranty and they will collect it tomorrow morning for repairs. thanks to all for the advice.
