hardship info needed

I have just tallied up my bank charges from the clydesdale bank and they come to £1500.
This is the bank that has just taken my husband to sheriff court for £3500 cc bill, which the granted an open decree, we havent heard anything back from the bank yet and i was wondering if we would be entitled to claim these charges back, due to hardship and use it to pay some of his cc bill.??
He is a self employed joiner with no work. x

Ok, I have to claim ignorance on Scottish processes. There is nothing that stops you from claiming charges(I believe it's £3000 in small claims courts), what you do with the money is up to you. I don't know about open decrees and their equivalent in England(apologies) or whether you can get the decree set aside based on the amount.0
