Alliance and Leicester Bank charges

Hi

I posted a chq off my banks charge nearly 6 weeks ago and only just the statement last Friday. The following day i recieved hardship forms which stated they need the info with 10 days of the letter or they would cancel the claim. The letter was dated 21st may 2009 and i recieved the letter on the 30th May. Which showed i only had one day to get the letter back with all the info and being a Saturday wouldn't recieve until the Monday/Tuesday. Any way I phoned them today to ask if they had recieved the letter and info which i was inormed they had, i asked what was the process as i was claiming under hardship and was told because i closed my account i would have to wait until the test case was heard and that if the account was till open they would only refund the last 6 months of charges. Please can some one tell me if this is right.

Is the account open or closed?
Who has sent the Income and expenditure form?
Do you know how much you are owed?

I tend to agree with them, and apologies but my eyesight is clearing going, as you did put the title as Alliance and Leicester(I didn't pick up on the obvious ;) ).
When did you close the account? Have you got a new account? Is there any priority debt arrears(mortgage/rent, council tax, utilities)?
