When can I stop worrying about BRU?

Hi all,

It's been a while since I posted on here. I went BR last Sept and you all gave me loads of help back then-thank you! :T

I'm back now with another question though. I thought I may get a BRU (it was mentioned as a possibility during the interview), but 9 months in and we haven't heard anything yet. I know a BRU can only be imposed up to discharge, but how long does it take to do? When can I stop worrying about it as a possibility?

    Not 100% but i think it's something like 6 wks before discharge that they need to apply for a BRU,so that it starts when your discharge takes place

    Hi CG77, I know that this sounds silly but are you sure you are not discharged, many discharges occur at about 6 months and in my case the OR did not tell me i was discharged, I called them about something else and she told me that I had been discharged 6 weeks earlier! It happened to my OH as well in 2004 he called to see if he was nearing discharge and they said he already was.

    Dalip, would we hear something then too? Would we need to be interviewed again or something? What I'm trying to say is do you think I can relax if it gets to 6 weeks before and we haven't heard anything? Thanks again for replying. :-)

    hermoine, I do keep checking insolvency.gov.uk but it still says I'm BR unfortunately! Thanks for the tip though! :-)

    This place is so busy and my age is playing with my memory but i am sure we had somone recently that was called in for an interview to determine whether a BRU would be applied. Yes they would contact you at some point,as they do like an offer thing. If you accept the BRU they take a few months off,if not it goes to court which takes time. Hang on just want to check something.Dx

    CG77, All I can suggest is keep very quiet and hope.

    We knew we were going to get IPA's, but heard nothing after our telephone interview for nine months. We started to hope that maybe we had escaped, but no such luck!!!

    The most annoying part is you get used to having all that extra money, which makes it hard when the IPA actually starts.

    would they not need to re-interview the BR before the 6 weeks so I would think you should be fine?

    I think this is what is going to happen to me. Does you IPA start from the date you went
    BR or does the IPA start that day and last for 12 months or is it 36 months?

    Lost2, your IPA starts from whenever it's set up and lasts for 36 months, as long as your situation doesn't change (you lose your job or your income drops suddenly for some reason), in which case it can be suspended.

    to be honest CG you will have heard by now if your OR want to put a BRU/BRo against you . it was mentioned to me at my interview but ihave heard a pip from my OR since my interview last year and i wil get my AD next month.

    yes your IPA start from when it is set up and last for 36 month ( unless it is a NIL tax code IPA) , even if you stop paying and/or your situation change you will have to inform the OR until the 36 month has elapses
