Builders going into liquidation

Hi,

I'm just buying a house and am trying to get hold of some information from the original builder, as it was built in 2001 - i.e. does it have an NHBC guarantee; Zurich guarantee; and a few questions from the survey. The original builder has voluntarily wound up (although now operates under a different name!) and informs us that they have destroyed all original documentation.

Does anyone know what the legal situation is - like what obligation is there of the original builder to retain documentation? And do potential buyers get hold of information raised on the survey, if the builder no loner exists? (or won't play ball...)

    Who is selling the house? It's the Seller's responsibility to have all the relevant information in a HIPS Pack. Even if it's a Building Society/Bank in the case of repos.

    Ask your solicitor to speak with theirs. But something should have been filed with the Local Building Control/Planning Office.

    Not really clear what informaiton OP expects to get form the original builder. Perhaps he would elaborate?
