Hi All,
I have just come home from an exhausting meeting in London to find an offer letter from Crapwest... I am a little annoyed as once again the offer is being made and is due to be offset against my 'arrears'.
Now I made it perfectly clear in my last letter that I owe money to other organisations and offsetting would mean that I would not be able to pay an equal share to all my debtors.
Please, please please can someone tell me if I can fight this?
If I have to go to court, I will. The offer is just short of £3,000, but the money owed by my calculations is almost double that?
Can anyone offer some advice how to proceed.
Thank you in advance
Much appreciated
Chicqa

Hiya Chicqa
First of all well done on your success.:T:beer:
So they have ignored your request and did they not send you a letter to explain why they would not do this?
So they are stating because you have arrears that this will be paid towards them, and if anything left over it really should be paid directly to you, have they stated that at all?
I would definately write back and tell them your not happy about the way its being done, as its no fault of yours that you were mis sold the policy.
Have they admitted liability?
Or was this an offer of goodwill?
Sorry for all the questions, just want to make sure I got this right.;)The one and only "Dizzy Di"0 -

Hi Di,
So good to hear from a friendly face (you know what I mean.xx)
Yes, they wrote back and said the offer was 'gesture of goodwill'.. Now I have been more than patient with them, seeing as they cannot locate my agreement nor could they send anything more than bank statements when I paid £10 for a SAR's!!
I have even given them extended time to deal with this matter and they have ignored my request.
What can I do??..

Hi hun
Awe bless......:A;) you too X
Just a thought, but do you know if the offer is much different to that of the full amount of PPI you have already paid?
If you have not signed anything yet, you could also ask the FOS to investigate this for you, but if you signed I am not sure if you can actually go back on this to be honest.
I would write and give them 5-7 days at the most, and also write in about how you feel you were not treated fairly here, and with what they should have supplied to you within the SAR you paid for as a right to the information, you could actually contact the Information Commissioner Dept to report this.
Tell them you feel they could at least consider this option of paying you this direct due to your current reasons of financial difficulty where you are trying to make ends meet.
I was wondering if your local MP would be able to write to them on your behalf??;)The one and only "Dizzy Di"0 -
As i mentioned in my above post about contacting your local MP, some will be able to write on your behalf and can help in these matters and especially due to your current circumstances, I would personally give it a go and contact your MP tomorrow, tell them its an urgent matter and it needs dealing with promptly.
How to find your local MP here:
http://www.parliament.uk/
On the right hand side of the page, you will come across a box, write in your postal code and your local MP should come up.;)The one and only "Dizzy Di"0 -

Your very welcome hunni.;)
If you get no joy please post up to let us know, we will try to think of something real quick.
They should be fair with you here really, they did not enclose everything they should have, so in my opinion there is no harm in them doing this for you as a goodwill gesture also.
Hope your MP can help, good luck.:A;)XXXThe one and only "Dizzy Di"0 -

Di,
I need to ask another question... The amount offered is just over 50% less than what I believe is owed. I just need to be clear, I have my own copy of the agreement, but am I claiming what was added at the beginning of the loan plus interest applied on application and also interest added on arrears?
I need to be clear and make sure what I have been offered is a realistic amount?
There has been no breakdown with the offer letter.
Sorry to keep pestering you...

Chicqa, they need to provide you with the written breakdown of this, ask them to post it for ASAP, if this was with the FOS now they would have to do this, tell them that. xX

I've just been trawling google and found the following info:
RBS must give you the money back....they cannot take it to pay off the loan amount as this would be misappropriation of funds...if they had a CCA agreement they could do that it is called "off setting" but they cannot do it with that CCA agreement .
The other issue is, I also claimed PPI on my credit card, but the account no. isn't even mentioned so I guess it wasn't included?...

I would print that off Chicqa to back your letter and tell the MP.
And in regards to the credit card this is separate then I take it.;)XXThe one and only "Dizzy Di"0
