can anyone give some urgent advice here please. my daughter in law has been clamped. she was parked close to a private road where clampers run riot, but was not in the road. the clamper saw her park up, close to the school where everyone parks, and watched her walk towards the school and didnt say a word. within 30 seconds all the other parents were chasing her up the road and shouting that she was being clamped.
all the parents were outraged, and teh clamper must have been worried about the crowd that was gathering because he drove off quite quickly, without giving her any paperwork.
one of the chaps there was so furious, and because she didnt have a penny on her (and who would carry £120???), that he, a complete stranger, paid it for her on his card saying 'there is no way you should have been clamped there'. after he had made the phone call, the clamper came back and gave her the paperwork, when he took the clamp off.
how do we go about getting this money back?? the clamping clearly shouldnt have happened but we all know that they are a law unto themselves.
i just dont know what to do first. any help would be good andi will take this all the way if i have to. thanks everyone.xxx
he actually stood there and watched her get out of the car and didnt say a word. then waited until she walked away and clamped the car.

Post the paperwork here washed of personal details. the first step is to make sure the clampers are SIA registered, if not report to the police.
If paid with a credit card see if the stranger who paid can get the CC to issue a chargeback as the payment was made under duress. You may need to argue with the credit card company over this, but insist it is done.
If this can't be done, issue a claim in the small claims court. If you take this route post here for help in formulating your particulars of claim.
Contact the local press and see if they will carry the story.0 -
sorry its taken so long to get back on here. have been away with no internet access. not home for another ten days but will do all that wheni get back.
the poor thing is just pregnant as well, this is really all to awful. a few days later when she went back to the school, mr clamper was back there again watching for other unsuspecting people to park there and she saw him and stood on the pavement shouting at people to go back to their cars and move them. he didnt get any that day!!!!
the man was just so horrible. even when she was literlly on her knees in the street crying that she had to get her son home from school, he went to within a few inches of her face and said 'tough'.
will try and get hold of her whilst i am away and get her to contact the chap who paid it for her.
thanks for the help and will come back here when anything has happened that needs talking about. thanks again.0 -
Should you need any assistance then get copies of both sides of any paperwork given, if the clamper was really operating on a public road he needs to be stopped quickly. The only way will be to gather all evidence and proceed from there. It might be an idea to point the "good samariton" in this direction as well.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

ok. so this is it. just dont know what to do first without a little bit help here. you will see that the drivers name isnt on the form, nor has the driver signed it. the only name on the form, is the one in brackets on the address line, who is the person who paid it for her.apart from mr clampers name of course.
was thinking today maybe we should get on to highways and find out just WHERE the road in question begins, in relation to the main road.
any help on this will be greatly appreciated.0 -
.Yes, get onto highways and find out just where the public road ends and the private begins. Have you found out who the good samariton wt card.eback, even if its a visa debi He/she should be able to get their money back via a chargas?I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

she as going to this week but i think she feels a bit embarassed.
i think the way forward on this, is for me to write him a letter and point him to here, and get her to put it in his door.
thanks for your help.0 -
Did she not think to call the police?0
