  • i have never seen an IVA with such low repayments, but maybe they do exost. but i would have though the IP would take almost all of the contributions in fees. if things are that tight and £100-£200 woudl be a struggle, surely bankruptcy would be better option?

    You poor thing - it does sound as though bankruptcy might be the way forward. At least it will be out of your hands then so to speak - the OR can deal with your creditors so you won't have to go through all this horrible stress. :(

    Don't worry too much about the procedure itself, from personal experience I can tell you it is extremely rare for a judge to refuse a debtor's petition for bankruptcy. You will probably spend all of two minutes in the presence of the judge - it is usually a quick in and out (ooh matron!) :p and you will have a court clerk with you. The judge won't tell you off either; they are usually very understanding and can tell when someone is genuinely in a pickle.

    Obviously you really need to get legal advice first as the judge won't proceed if you haven't, but this can just mean speaking to CAB.

    All the best, it's not the end of the world and one day you will look back and feel proud that you got things sorted out. :)

    I have told on creditor who cant understand that I have no more money that if they pursue , the "Undue and relentless pressure will likely push me back into depression. At which time previousley and likely in the fututre there will be no money for them, Bankruptcy will be my only option. I dont want it and neither do you. " they still call every day

    I now have 6 months work , but if they pressure and in six months wont help me , then I will seriousley look at this option. It does drive you round the twist and I am sure that if all othe roptions are exhausted then this is the answer.

    Awwwww, best of luck Charlotte. I went down the bankruptcy route and it was the best thing I have done. Two years on I am still debt free and actually have savings. I learnt my lesson and will never be in debt again. Mind you, I am still being chased by one creditor. Let them chase. I don't care anymore!.

    Just when we thought......

    OH got offered a job yesterday!!! woo-hoy!!!!

    Its 4k more than me - and I will have to give up work as we cannot afford to pay for childcare at all (for 2 kids), but what it means is that we can now hopefully do a DMP (talking to CCCS tomorrow!) and not visit the county court!!!!!

    A sigh of relief on this one.

    Still kicking, still trying to keep our heads above water!

    I sell on ebay occasionally anyway, may do a bit more again - plus I can do a bit of secretarial home work, so hopefully we can get a little bit of extra cash!

    Hi Charlotte.. looks like things maybe turning a corner for you. I went bankrupt almost 2 years ago, still debt free and no hassle off anyone. I am so glad and relieved I took this route.

    I had loads of hassle from Halifax, they were really threatening to me before the bankruptcy order. saying things like "we'll get you when your son is 16 and left home". I was very upset by them..haha, but the last laugh is on me, Iowed them over £29,000 (my ex's debt on a house, but he lived there and my name was on it, unfortunaltey for them!)
