XL failure, credit cards and ATOL.

So, months down the line from the XL failure, having claimed refunds for a holiday booking from my credit card company for the part of the deposit paid for by card, and from ATOL for the other part, paid for by cheque, ATOL have now written back saying that they will not pay, and that I should claim the full amount back from the credit card company using section 75 of the Consumer Credit Act. Unsurprisingly, the initial response from the credit card company representative is not hopeful. (they did credit the account very quickly with the amount claimed from the card payment). They will, however, examine a claim from me if I send them the details.
My point is, whats the point of having ATOL protection if they are not going to give you any!
Has anybody else experienced this issue ?

    because they are overwhelmed by this failure(a rather expensive one at that)

    so if you can claim of your credit card company they tell you too so they can pay the people who didnt as they have no other protection.
    Back by no demand whatsoever.
