dro help please

can i am going to tribunal for dla hopefully sometime in july, but could be up until sept at the latest, my query is if (fingers crossed) i get it, and it is backdated, what will this do for my dro? i haven't paided yet for it yet but want to and have the cash ready, i asked my intermediary who hasn't got back to me just yet,i have spoken to the cab, who said it shouldn't count and i have rung the insolvency service, who said if it is more than £300 my dro could be withdrawn, thats fair enough but i owe the money to my dad who has been paying for stuff for my disability since december when i put the claim in for dla, please help i don't want to lose the £90, but cannot put off paying it and getting the dro underway

    Can you get the money paid directly into your dads bank account?
  • i don't know, will they do that, thats a good idea i hadn't thought of that
  • hi i just rang up the tribunal service, and they said it should be fine for it to be paid into my dad's account, going to the post office in a min

    Hi,

    I think you would put your £90 at serious risk. Back dated benefits are counted as an asset in a DRO, So if over £300 would probably revoke your DRO. You have a duty to inform of any changes in your DRO year.

  • too late now, i have already been and paid, i will just have to hope if i do get dla backdated then it will be less than £300, i know i have to inform them if i do get it but i was told dla doesn't count on your income expenditure becuase it goes in and comes out for instance i would use it to pay for someone to clean my house, and do the garden, i have bad mobility and balence problems and cannot do them myself

    Your right to say that DLA goes in as income and straight out again as care needs, but all backdated benefits count as assets in a DRO, unlike BR where they are exempt !

    Its just daft.

  • but that is stupid, my dad has been paying for my care needs since december as i cannot cope anymore, why should he be out of pocket when if i get the money i could pay him back? because i am never going to be able to py him i am on income support, the thing is it would cost all or nearly all of my potential backdated amount to go bankrupted, so there does not seem much point in going down that route.

    well if the worst comes to the worst and i lose my £90 at least my creditors would have been kept off my back for a bit, but i still have to find £90 to pay my mum back
